Almost two years after the European Council approved the creation of the Next Generation program

tracking cases of fraud

in the execution of these millionaire funds, whose deployment is being carried out in an accelerated way.

The funds "

have already been targeted by fraudsters

seeking to illegally access these billions of euros of resources. Although safeguards have been put in place to

prevent abuse

at national and European level,

the authorities have had to distribute these aids so quickly

that this it

has weakened some of the

due diligence procedures

and has already allowed

some criminals to profit illegally from these funds

", warns Europol in its latest report on economic corruption in the Union.

This agency for police cooperation launched

Operation Sentinel

in October 2021 -

, in French - to track fraud in European funds, together with the European Public Prosecutor's Office, Eurojust -agency for criminal judicial cooperation- and

OLAF

, the EU office dedicated to investigating fraud, corruption and misconduct serious in European institutions and countries.

This last office is dedicated to investigating

alleged cases of fraud

as a result of clues or indications it receives from abroad -among its ranks it has former members of the police from different countries or even former agents of national intelligence centers-, although it can also investigate specific cases on their own initiative, sources familiar with their procedure from Brussels explain to EL MUNDO.

"The prevention of serious cross-border crime is at the core of Europol's mandate, and we are fully committed to supporting Member States in fighting any

attempts by organized crime

to infiltrate the legal economy of the EU and

the NextGenerationEU fund.

"Our message is clear: any threat to the NextGenerationEU is a direct threat to the financial well-being of the European Union and its citizens.

Operation

Sentinel will

strengthen our joint response to fraud

and protect the rebuilding of our communities," said

Catherine de Bolle,

Europol

This organization knows that the 672.5 billion euros of loans and aid with which the Union's economies are being irrigated, to rebuild and transform them after covid,

attracts criminal groups active in the European Union and outside it

who will seek the tax evasion, excise fraud, corruption, embezzlement, misappropriation and money laundering.

These networks have already been

operational during the pandemic

and Europol and OLAF have intercepted some of them.

An example could be the

criminal group arrested in France

by the French Gendarmerie and the Israeli police for defrauding the French state of €12 million through

3,600 shell companies channeling unemployment funds

.

Once the benefits were received, the funds were transferred abroad and exchanged for cryptocurrencies.

"Apparently,

the magnitude of the aid has drawn the attention of criminal organizations

[including the

Italian mafia]

and Europol has decided to open a new line of investigation. In fact, the organization intervened last June in the dismantling in France of a criminal network to appropriate European funds aimed at unemployment," says the

PwC European Funds Office.

It was perhaps no coincidence that the first meeting of the

Sentinel

project was held in

Rome

in September 2021, so that the judicial and police institutions attending could coordinate in the face of possible threats to recovery funds.

A second meeting was held in April this year, in

The Hague.

Europol expects that "

some criminals will specialize in abusing these plans by

orchestrating

complex networks of companies

in order to defraud public funds."

And it warns that "billions of euros of public revenue could be lost through VAT and other fraud", which will harm the interests of taxpayers and, in the end, the ability of governments to finance essential public services.

"Cruising speed" in Spain

The main reason why these cases of fraud can occur is in

the speed

with which the authorities are deploying these investments, explains Europol, a pace necessary to be able to execute such a volume of funds in six years.

In the case of

Spain

, the Government has at its disposal a volume of

140,000 million

, of which

71,604 million

are received as non-refundable transfers -in exchange for meeting certain milestones and objectives associated with investments and reforms- and around

68,400

will be formalized in loans to repay.

The Executive has confirmed the request for the subsidies and is preparing an addendum to the Recovery Plan to also be able to access the

loans

.

To do this, it will have to commit to carrying out

new reforms and investments

consistent with the

specific recommendations

that the Commission has made to Spain in the spring package presented this week.

The money from the transfers is received through two mechanisms:

59,168 million

under the

Recovery and Resilience Mechanism

and 12,436 million from React-EU.

Of the 59,168 million euros of the Plan,

the Government included 24,198 million in the General State Budget (PGE) for 2021

, since its intention was to execute all that volume of spending to reactivate the economy after the pandemic.

Of that total, the Executive only managed to authorize (approve)

expenses worth 22,790 million

(94.2%) in 2021;

commit expenses amounting to

20,977 million

(86.7%) and

transfer 11,200 million to the Autonomous Communities

for them to distribute.

It is unknown, however, how many of these funds have reached the companies.

In practice, this means that the

actual execution

-or arrival of funds to the economy- was very low, hence the Independent Authority for Fiscal Responsibility (

AIReF

) has estimated that the

impact of the funds on GDP

has been almost

nil

. .

In

2022

, the Government has promised to

deploy another 27,000 million euros,

which will be added to those that remain to be executed,

with "cruising speed"

.

It is estimated that the impact on GDP will be new tenths, but this accelerated pace may entail

security risks

, that is why the "

sentinels" are vigilant.
