If the Government again prohibits objective dismissal, will the workers be protected?
The president of the business association,
Antonio Garamendi,
has harshly charged this Tuesday against the
Minister of Labor, Yolanda Díaz
, after learning that one of the measures included in the Shock Plan approved today by the Government to alleviate the impact of the war in the Spanish economy is the
prohibition of executing objective dismissals for economic reasons in an appropriate manner.
"If it seems very good to the minister that she cannot be fired,
let her set up a company and do it
," Garamendi snapped at an event in Zamora, according to statements collected by EFE.
The leader of the businessmen has criticized both the approach to dismissal and the measures relating to the cap on the rise in housing rentals.
His criticism came minutes before Díaz herself announced at the press conference after the Council of Ministers that from now
on the dismissal derived from an increase in energy prices
will be considered inadmissible .
"
The dismissal will be unjustified when it occurs for reasons that have to do with the increase in energy prices
(...)", said Díaz, who explained that "since the companies are going to receive public aid, if they do They will have to return them."
Companies that benefit from a Temporary Employment Regulation File (
ERTE
) may not resort to dismissal either.
However, despite the fact that the initial vocation of the minister was that fair dismissal was not an option for any company, in the end
it will only apply to those that have received some type of aid
and until the month of
June
.
It is unknown for now what kind of public aid they refer to.
In the absence of reading "the small print" regarding these measures that will be included in the Official State Gazette this Wednesday, the president of the employers' association has said that he
does not share the measures that involve "interfering in the economy in what is freedom of action and business".
For this reason, he has recognized that he has been "surprised" by Yolanda Díaz's approach and her announcement that "it is forbidden to fire" since it
is not adequate in "a market economy, in the free world."
He recalled that
when employers lay off they do not do it "out of hobby"
as it may sometimes seem from the perception that they have, but when the situation is "very complicated" or they are fired or wages or other costs are reduced or the company closes.
Accuses the Government of interventionism
The president of CEOE has described as "interventionism"
what the Government announced about the dismissal and, although the businessmen still do not know how far this measure will go, "in advance" it will not "seem good".
For Garamendi, the most necessary things for "the economy to flow" are
legal certainty, regulatory stability and the quality of the norm,
since they are "much more important than all the specific measures" that are adopted, by generating mistrust business.
In relation to the
reduction of 20 cents per liter in the price of diesel,
the president of CEOE has argued that it would have been more appropriate to direct this measure specifically to sectors such as transporters or the countryside, in line with what the Bank of Spain, which called for "granular" measures aimed only at "the vulnerable".
"I don't see a generalist measure
because there are people who don't have that need from the point of view of saving consumption," Garamendi declared to explain that if it had been addressed only to the most affected sectors, the average could have been "more surgical for them".
He has asked
for time to assess other measures
such as gas not being taken into account in the price of energy, since it will be necessary to see the proposal that Spain presents to Europe and that the European organizations approve, so it will not be ready before a month.
Regarding
ICO credits,
he has indicated that European regulations will have to be assessed, since if an entrepreneur takes advantage of a moratorium on the payment of these loans "by European regulations he can no longer request any credit because he is in arrears."
