Between the democratization of e-commerce and the inventiveness of criminals, credit card fraud is not in crisis.

In 2020, it indeed cost 1.28 billion euros to the French, according to the Observatory of the Banque de France.

Fortunately, the legislation protects victims by imposing strict reimbursement rules on banks… at least when they are respected.

What the law says

Have you noticed one or more payments that you have not yet made to your bank account?

At the slightest fraudulent operation, you must immediately oppose your credit card to stop the bleeding.

You can contact your bank's own number (it appears on its website, your contract and on distributors) or, failing that, reach the interbank server at 0.892.705.705 (paying service).


It is then a question of making the accounts to determine from when the fraudulent payments began and how much they amount to in order to request the restitution by your bank.

The good news is that the law gives you up to 13 months from the date of debit to act, but obviously the sooner the better.

Pursuant to Article 133-18 of the Monetary and Financial Code, the banking establishment must "immediately" reimburse all sums debited in the context of an unauthorized payment transaction reported by the user, as well as the possible agios that may have resulted if these punctures exposed you.

Only limit: in the event of loss or theft of your credit card, 50 € of losses will remain your responsibility.

What banks do

Although the legislation does not require you to file a complaint, be aware that the majority of banking establishments require this prerequisite to activate the reimbursement procedure.

It's basically a way to show your good faith.

You will therefore have to go to the police station or make a report via the Perceval teleservice.

Despite this formality, banks are not always very responsive, as deplored by the Prudential Control and Resolution Authority (ACPR) and the Banque de France in 2021. Based on a questionnaire sent to 25 service providers of payment services, the gendarmes of the sector have in fact estimated that

“the procedures for processing requests for reimbursement of unauthorized bank card transactions must be improved”.

At the top of the list, the legal deadline for returning funds within one working day at the latest following receipt of the dispute is not well respected.

Banks also tend to argue their client's suspicion of fraud to drag out the procedure, without respecting the procedure in this area.

Remember that it is in fact up to the institution to prove your gross negligence or fraud and that in the event of a presumption, it must declare it without delay to the Banque de France and conduct an investigation “within a reasonable time”.

If the final decision is a refusal of reimbursement, it must also be rigorously reasoned.
