• Chaos in companies before the end of the ERTE: "They end on February 28 and nobody knows anything"

A total of

8,237 workers

have been included in a

Temporary Employment Regulation File (ERTE)

in the last thirty days.

Companies have resorted en masse to this system against the clock for its extinction, which can be interpreted as a way to pressure the Government and ensure that these protection systems are extended beyond February 28, or as a symptom of the cooling of the economy.

According to the affiliation data advanced this Friday by the Minister of Social Security,

José Luis Escrivá

, between January 13 and February 17 the number of ERTE workers in the country has gone

from 110,574 to 118,811,

which represents an

increase 7.4%,

after months of declines in the use of this system.

The data disaggregated by type of ERTE shows that

not all of the increase is due to the expansion of the omicron variant

, in fact most of the employees who have been included in this instrument in the last month have not done so due to the pandemic or administrative restrictions derived from the health situation.

Of the 8,237 that have been affected,

5,246 have been included in ERTE for economic, technical, organizational and productive reasons (ETOP)

, the most used by the industrial or automotive sector, due to the lack of supplies, and by those companies from other sectors that

can no longer prove that their drop in activity is due to the pandemic.

These ERTEs

do not entail exemptions

in the payment of social contributions to Social Security and, therefore, do not imply a commitment to maintain employment.

For its part, the number of workers included in a

covid ERTE

has grown by

3,602 people since mid-January

, due to the increase in the accumulated incidence and the measures imposed in some communities.

The number of employees affected by the special ERTE that the Government enabled in the face of the eruption of the

La Palma

volcano

has dropped by 610 people

in the last thirty days.

These fluctuations place the total number of workers affected by a

covid ERTE at 104,363 people,

at the end of last Thursday, while there are

13,644 affiliates in an ETOP ERTE

in the country and only

804 in a special ERTE in La Palma.

Most of those who have been included in ERTE in this time have been with

total suspension,

since 5,523 of those affected do not work any day of the week, while 3,325 have been included in an ERTE of

partial suspension,

that is, they are active but work fewer hours.

In total, 62,562 affected by ERTE have total suspension and 55,445, partial.

“We have reached the end of the ERTE when

the number of those affected has stabilized at levels that are very low

, around 50% of those affected are active and with a unique sector, especially affected, which is travel agencies. ", Escrivá has celebrated, despite the fact that many of those affected by ERTE have not worked for almost two years.

This sector has not been able to recover from the decline in activity and every day more names of companies that are negotiating new ERTEs or intend to extend those that are in force, such as

Nautalia

or

Halcón Viajes, are becoming known.

With the entry into force of the labor reform since last January and before the end of the last royal decree of extension, which expires on the 28th, companies have to resort to other channels in the face of scenarios of collapse of their activity.

They have three options: opt for the

limiting ERTE or by force majeure

that regulates article 47 of the Workers' Statute -but which are much more restrictive and to be approved there must be administrative restrictions that prevent activity-, resort to the

ERTE ETOP

-which have always existed- or opt for the

RED Mechanism

as long as the Government has activated it.

At the moment, they only have it planned for

travel agencies, which have 10,800 workers in ERTE.

It is an

emergency umbrella

in which only those sectors that the Government considers in need can be sheltered, either because the sector is being structurally converted (sectoral mode) or in the face of an economic shock (cyclical mode).

Companies that cannot benefit from the RED, will have an

adaptation period to transition from the previous ERTE to the new ones

, which will foreseeably last

a month

, according to the second vice president and Minister of Labor, Yolanda Díaz.

In that time, they will have to request the ERTE limited or due to force majeure, which will probably be granted to few, or negotiate an ETOP.
