The independent experts of the so-called 'Plus Ultra case' declared this Tuesday before the investigating judge that the airline did not meet the requirements to be rescued by the Government, according to legal sources present. In a confrontation organized by Judge

Esperanza Collazos

, the team of independent experts headed by

Pedro Martín Molina

, have argued for three and a half hours that Plus Ultra was already in crisis before the pandemic and, therefore, did not comply. a basic requirement to be able to be saved by the Support Fund for the Solvency of Strategic Companies. This state instrument was created by the Government to save viable companies. "

Plus Ultra was in a limit situation or the following before the rescue, we all know"

, they have come to say throughout the statement.

These are those who wrote the report commissioned by the court who have appeared in the confrontation along with those who signed the one requested by the State Society of Industrial Participations (SEPI).

One and the other have ratified their conclusions in this case in which it is investigated whether there were crimes in the granting of public aid of 53 million euros granted to the airline.

The confrontation has been prolonged by multiple questions from

Esperanza Collazos,

the State Attorney, the Prosecutor's Office and the popular accusations made by Manos Limpias, PP and Vox.

Also from Plus Ultra itself.

On behalf of Sepi, representatives of DC Advisory and Deloitte have appeared, who provided financial and legal advice to the Government to guarantee the rescue and who have insisted that, in their opinion, all legal requirements were met.

Independent experts have attacked in particular, according to the sources consulted, the participative loan of 6.3 million euros that the airline received from Panacorp, the key Panamanian securities company so that Plus Ultra did not go bankrupt before the pandemic.

In the opinion of these experts, the "participatory loan" of Panacorp, linked to the Venezuelan owners of the company, had no other purpose than to offer the image that Plus Ultra had not entered into cause for dissolution.

In the interrogation they have been more emphatic than their written report in which they already advanced "more than reasonable doubts" about what the company's financial situation was as of December 31, 2019 and, consequently, about compliance with the conditions essential for the granting of public aid through the State Society of Industrial Participations (SEPI).

For her part, the legal secretary of Vox,

Marta Castro

, has assured in statements to the press, according to Europa Press, that it has been "an essential test" and that, in her opinion, "it has been very interesting to see the contradictions" between the two teams of experts, since there have been "many nuances" and "accounting interpretations".

Castro has announced that they will request the declaration of the legal representative of Plus Ultra and also of those responsible for SEPI.

"

Without these statements it seems to me that the investigation is, perhaps, incomplete

. And we should not make hasty decisions," he said.

From the formation led by Santiago Abascal they have insisted that the airline disguised its situation in order to access public aid and have also recalled that there are "personal ties" between Plus Ultra and the government of Nicolás Maduro.

"That is something that we believe must also be evaluated," he added.

After the confrontation on Tuesday, the judge will have to decide whether to continue with the investigation, as the accusations request, or if the file is agreed, as the Prosecutor's Office and the Lawyers demand.
