In the form of subsidy tax deposits, temporary countervailing measures are imposed on imported polyphenylene ethers originating in the United States.

  According to the announcement, in accordance with the “Countervailing Regulations of the People’s Republic of China” (hereinafter referred to as the “Anti-Subsidy Regulations”), on August 14, 2020, the Ministry of Commerce issued Announcement No. 32 of 2020, deciding to consolidate imports from the United States. Phenyl ether (hereinafter referred to as the product under investigation) is subject to an anti-subsidy investigation.

The Ministry of Commerce investigated whether there are subsidies and the amount of subsidies for the products under investigation, whether the products under investigation have caused damage to the domestic polyphenylene ether industry and the extent of damage, and the causal relationship between subsidies and damage.

  According to the findings of the investigation and the provisions of Article 25 of the Countervailing Regulations, the Ministry of Commerce preliminarily ruled that there are subsidies for imported polyphenylene ethers originating in the United States, and that the domestic polyphenylene ether industry has suffered substantial damage, and there is a gap between the subsidy and the substantial damage. There is a causal relationship.

  In accordance with the provisions of Articles 29 and 30 of the Countervailing Regulations, the Ministry of Commerce proposed to the Tariff Commission of the State Council to adopt temporary countervailing measures against imported polyphenylene ethers originating in the United States.

The Customs Tariff Commission of the State Council made a decision based on the recommendations of the Ministry of Commerce to implement temporary countervailing measures against imported polyphenylene ethers originating in the United States in the form of temporary countervailing duty deposits from October 15, 2021.

When importing products under investigation, import operators shall provide corresponding temporary countervailing duty deposits to the Customs of the People's Republic of China based on the ad valorem subsidy rate of each company determined in the preliminary ruling of the Ministry of Commerce.
