One of the biggest financial scandals of the recent past is preoccupying the Federal Court of Justice (BGH).

On Monday, the fifth criminal senate in Leipzig negotiated the revisions of former top managers of the now insolvent Infinus group of companies.

The five defendants were sentenced in the summer of 2018 by the Dresden Regional Court for commercial and gang fraud as well as capital investment fraud or aiding and abetting to imprisonment between four and a half and eight years.

All had appealed against this decision (Ref .: 5 StR 443/19).

Before the Senate, the defense lawyers of the former Infinus leadership explained why the verdict should be overturned.

Not all witnesses named were heard in the criminal proceedings.

The defense also complained that they had not been given access to all data and documents seized in a raid.

If the BGH overturns the judgment, another criminal chamber in Dresden would have to decide the case again.

In this case, the lawyers applied for a transfer to the Leipzig Regional Court.

The fifth criminal court will announce its decision on October 29th.

In the Infinus case, private investors were recruited into a “pyramid scheme” by faking fictitious profits.

The investment companies did not have a viable business concept.

The total damage amounted to 542 million euros.
