As Fotyga recalled, in June 2021, Nord Stream 2 AG applied for certification as an independent operator of the gas transmission system.


However, according to the MEP, the issuance of such a certificate is only possible if the corresponding gas transportation system existed before May 23, 2019 (according to the updated EU gas directive).

As you know, the pipeline of the company Nord Stream 2 AG ("Nord Stream - 2") was not completed by this date, the parliamentarian specified.

“Moreover, a company registered in Switzerland (Nord Stream 2 AG. -

) does not meet the basic certification requirement.

The regulator is obliged to refuse certification that endangers the energy security of any EU member state, ”added Fotyga.

Also, according to the Polish parliamentarian, the company allegedly does not want to comply with the basic rules of the EU's Third Energy Package.

"In particular, the owner of the gas pipeline (the Russian company Gazprom. -

) wants to evade the requirements for unbundling of property, third party access and transparent duties that should take into account the cost of the entire pipeline," Fotyga explained.

Another key factor that causes concern of the MEP in the situation with the SP-2 is the "negative impact" of the Russian gas pipeline, including on the security of energy supplies to the EU, member states and associated partners.

In this regard, Fotyga turned to the European Commission with the question of whether

what measures do they intend to take in order to force Nord Stream 2 AG to comply with the rules of the Third Energy Package, including the certification procedure - it is carried out by the Federal Grid Agency of Germany.

Earlier, German Chancellor Angela Merkel clarified the situation with the updated EU gas directive, which entered into force in May 2019.

According to her, the document enshrines a rule according to which a member country of the union itself determines whether the rules of the Third Energy Package apply to an offshore gas pipeline entering its territory.

In 2009, the Third Energy Package was adopted in Europe, the goal of which is to prevent gas suppliers from gaining a dominant position in the market.

In April, Russian Deputy Prime Minister Alexander Novak announced that Nord Stream 2 would be completed in 2021.
