The Superior Court of Justice of the Canary Islands (TSJC) has suspended in a precautionary way the measure of the Government of the Canary Islands to require the Covid certificate or a negative test to people who want to enter indoors in hotel and restaurant establishments.

This opens the debate on the legality of this measure, which

Galicia is also applying

and which some communities also want to apply.

Also countries like France, Italy or Greece.

Health has ruled out for the moment to generalize this measure, considering that the uses that this certificate has "are those determined by the EU," said the Minister of Health, Carolina Darias, hours after the Minister of Industry, Commerce and Tourism, Reyes Maroto, indicated that it would be studied with the communities.

"The uses (of the certificate) that are regulated are those contemplated by the EU

", that is, to facilitate travel and mobility within member states.

This "is the legal protection it has," said Darias yesterday, thus ruling out the general demand for it.

The Covid certificate

was approved within the EU to facilitate travel between member states.

This passport certifies that the person is vaccinated, has passed the disease or has a negative PCR test performed in the last hours. That is, it does not present a risk.

It was always emphasized that it was not mandatory to be able to travel.

Therefore, making it mandatory to enter bars or clubs raises doubts.

In fact,

the hospitality industry discards it

, since it believes that it is an extreme measure that would not help to recover the lost activity, but quite the opposite.

However, nightlife does see it as viable, since the first thing that closes when contagions grow are the discos and they believe that this certificate would provide security guarantees to avoid the closure of the premises.
