China News Service, Beijing, June 11 (Liu Liang) The Standing Committee of the National People's Congress recently voted and passed the "Decision on Amending the Work Safety Law of the People's Republic of China", which will be implemented on September 1 this year.

The revised "Safety Production Law" proposes to increase penalties for violations, and fines for particularly serious accidents can be up to 100 million yuan (RMB, the same below).

  At a press conference held on the 11th, Song Yuanming, Vice Minister of China's Ministry of Emergency Management, introduced that this revision of the "Safety Production Law" has increased the penalties for violations, which are embodied in the following three aspects.

  First, the fines are higher.

This amendment generally increases the amount of fines for violations. As far as the fines for accidents are concerned, the amount of fines for accidents has been increased from 200,000 to 20 million as stipulated in the current law to 300,000 to 100 million; the amount of fines imposed on the principal person in charge of the accident has been increased. Increase from 30% to 80% of annual income to 40% to 100%.

  Second, the punishment method is stricter.

For example, if no measures are taken to eliminate the hidden dangers of the accident, the current law shall first order rectification, and then order to suspend production and business and impose a fine if it refuses to rectify. The amendment is revised to: once an illegal act is discovered, it will be ordered to rectify and fined. Those who make rectification shall be ordered to suspend production and business for rectification, and may be fined continuously on a daily basis. Those who refuse to suspend production for rectification shall be submitted to the local government for closure.

  Third, the punishment is greater.

Strengthen the joint punishment and disclosure of illegal and untrustworthy behaviors, increase the frequency of law enforcement, suspend project approval, raise relevant insurance rates, industry or occupational bans and other joint disciplinary measures, and effectively crack down through the "high-hanging sword" Deter illegal enterprises and protect the legitimate rights and interests of law-abiding enterprises.

  Song Yuanming said that the current work safety in China is still in a ramp-up period and a hurdle period.

The "Safety Production Law" was revised at the right time and was very necessary. It provided a powerful legal weapon for safe production work and provided a strong motivation for climbing the slope.
