Eventim suffered a setback in the dispute with the North Rhine-Westphalia consumer center over the reimbursement of advance booking fees for concerts canceled in the Corona crisis. The Munich Regional Court declared a clause ineffective on Wednesday in which the ticket retailer had ruled out a reimbursement of the advance booking fee in the event of the cancellation or postponement of events. At least in the cases in which Eventim sells the tickets on a commission basis, the clause disadvantageously disadvantages the customers, it said in the judgment (file number 37 O 5667/20). But that does not mean that all customers can now claim reimbursement of the advance booking fees for the concerts that had to be canceled due to the pandemic, said a court spokeswoman.It depends largely on the respective design of the contracts, whether the organizer owes the money or Eventim. The ticket dealer mediates tickets either through a commercial agency or as a purchase on commission. In the case of a commercial agency, Eventim would be responsible for the reimbursement, in the case of a commission the organizer.
