A huge wave of lawsuits is rolling towards the German administrative courts because of the corona aid.

The German Retail Association (HDE) expects that several thousand retailers are determined to enforce legal support according to the rules of November and December aid.

Around 10,000 retailers have applied for this aid by the April 30 application deadline.

This is the result of HDE projections based on a member survey from last week, the key results of which are available to WELT AM SONNTAG.

The application only makes sense for procedural reasons.

The merchants cannot hope for an allocation because the generous November and December aid are intended primarily for the catering trade.

After that, the state will replace up to 75 percent of the lost sales.

However, the requests from the dealers create the conditions for further legal action.

Those affected can lodge an objection to negative notices and thus initiate preliminary administrative proceedings.

This in turn is a condition for subsequent lawsuits against the violation of the principle of equality in the Basic Law.

Although many shops have been closed since December 16, they are not entitled to the extensive help, but are referred to the narrower fixed cost subsidy, according to the dealer lobby.

"This is clearly unequal treatment compared to the catering trade," said HDE boss Stefan Genth. Only fairer aid could avert the wave of lawsuits. A sample complaint has been prepared.
