The National Court has agreed to investigate whether four wineries of the

Protected Designation of Origin (PDO) of Valdepeñas

have sold as crianza, reserva and gran reserva wines that did not meet the production requirements, neither in the aging period nor in the permanence in barrels of oak or bottled.

This has been decided by the investigating judge

The order considers that the denounced facts could suppose crimes of

misleading advertising

fraud

.

In addition, since the content of the labels would not correspond to the characteristics of the product, the crime of

document falsification

would also have been committed

.

The judge - who asks the Police to collect data on sales, prices and category of wines from the wineries between 2010 and 2019 - indicates that together with the legal activity, the wineries could be carrying out other criminal activity, "taking place the latter in the placing on the market of quantities of wine with PDO Valdepeñas above those declared to the corresponding Regulatory Council,

without complying with the production conditions

that such denomination requires and, therefore, not responding to the quality provided in the labeling itself. of bottled wine ".

The complaint presented, says the instructor, reveals how the labels of the marketed bottles indicate that their content is wine of the characteristics "reserve or great reserve" and such specification is relevant and misleading information about the characteristics of the product directed to the consumer. , since the content of such bottles has been made without having respected the barrel aging times indicated in the specifications.

Such facts, he points out, are supported by the existence of the disciplinary proceedings of the Ministry of Agriculture accompanied by the complaint, in relation to the investigation of the administrative body in charge of wine control.

"Indeed, the fact that the wineries declare to the regional administration a quantity of wine sold to customers and that they declare different quantities, much higher than those declared by the wineries, is an indication of a lack of traceability of the wine, thus as well as irregularities in the marketing of crianza, reserva or gran reserva wines by the wineries in question ".

The numbers

The order details the allegedly irregular practices such as, for example, when in 2018

sold 1.6 million liters of aging, an amount higher than the sales declared to the Interprofessional Association of the Valdepeñas PDO, which amounted to 1.1 millions.

This difference is not covered in the declaration made to the Valdepeñas PDO for its sale as aging in 2018, according to the judge.

In turn, there is a difference of 614,968 liters of aging wine from 2018 between what was bought by six clients and what was declared by these wineries as sold to said clients with said aging qualification.

In the case of

García Carrión

, he reports that in 2018 the Grupo de Bodegas Vinartis SA and J. García Carrión SA verified sales of three million liters of Gran Reserva wine with protected designation of origin Valdepeñas to a single client.

The amount is higher than the total sales declared both to the inspection administrative authority (2.5 million liters) and to the Interprofessional Association of the Valdepeñas PDO (2.1 million).

Regarding

Bodegas Navarro López

, the resolution affirms that there has been a difference of 25,493 liters of crianza wine from the year 2018, with the PDO Valdepeñas denomination between what was bought by four clients and that declared by the company that has sold to said clients with said parenting qualification.

Likewise, it has been verified that in the referred year this winery sold 110,178 liters of reserve wines, a quantity higher than the sales declared to the Interprofessional Association of the Valdepeñas PDO (93,152 liters).

This difference of 17,026 liters is not covered in the declaration made to the Interprofessional Association of the Valdepeñas PDO for sale as a reserve in 2018. In turn, there has been a difference of 29,503 liters of reserve red wine from 2018 between what was bought by four customers and what was declared by the company that has sold to said customers with said reserve rating.

Finally, in the case of

Bodegas Fernando Castro

, the reported sales data do not coincide with the data recorded by customers.

For example, sales made to Alcampo differ by 1,367.55% in aging wines, and by 1,941.54% in reserve wines.
