CEOE has urged the Ombudsman, Francisco Fernández Marugán, to present an unconstitutionality appeal against the rise in the Heritage tax that the Government included in the General State Budgets (PGE) of 2021. It is, in the opinion of the businessmen, "

a confiscatory, unfair tax that threatens the freedom

and private property of Spanish taxpayers."

What's more, what the Government must do is "suppress it" because in this way, in addition, it will end the

fiscal

dumping

that the Minister of Finance, María Jesús Montero, always denounces.

This has been defended by both the president of CEOE,

Antonio Garamendi

, and the vice president of the employer's association and head of Foment del Treball,

Josep Sánchez-Llibre

, showing in both cases very critical of the Executive of Pedro Sánchez and his fiscal strategy.

"It is curious that in the entire European Union, the only country that has this tax is Spain.

There is no country in the EU that has this tax,

" said Garamendi, who stressed that this figure "taxes savings, something that it has already paid taxes "and that" does not promote wealth creation or savings. "

"It is not fair to tax the patrimony with 3.5% after having paid rent", has influenced Sánchez-Llibre, who has warned that there are taxpayers who "

have to sell an important part of their patrimony

" to to be able to face the taxes.

The only case in the EU

Entrepreneurs have wanted to highlight the aforementioned fact that Spain is the only country that has a wealth tax.

Until recently, France had a similar figure but decided to subsume it in personal income tax.

The Government, however, has no intention of modifying this situation, something that could seem contradictory to its intention to approach the model and fiscal pressure of Europe.

Moreover, Montero rejected the intention of United We Can to create a tax for the rich, pointing out that Spanish taxation already has a figure, that of Heritage, which allows taxing high incomes.

This year's accounts include the indicated increase from 2.5% to 3.5% of the maximum marginal rate, which is the reason that has unleashed the CEOE protests.

And, in addition,

the indefinite nature of the tribute is established

since until now it was temporary.

The Treasury estimate is that this increase contributes up to 339 million, but the reality is that it is a ceded tax and not all communities apply it.

This situation is precisely what has unleashed Montero's criticism, especially towards the Madrid Community and that "

fiscal

dumping

in which it incurs".

From the region governed by Isabel Díaz Ayuso they defend their right to give this figure a 100% discount and from CEOE they insist: the way to end this situation is by "

eliminating the tax

."
