By surprise and taking advantage of the decree that regulates the creation of the vulnerable consumer approved yesterday by the Council of Ministers.

This is how the Government has modified the anti-eviction law that it extended just a month ago and that, among other assumptions, included going ahead with the launches when entering or staying in the property was "a consequence of a crime."

The new wording, published in the Official State Gazette (BOE) this Wednesday, eliminates this assumption and instead introduces that evictions in homes occupied by people without a contract may not be suspended under the royal decree that protects the paralysis of launches when the entry into the property or its permanence

"has occurred through intimidation or violence against people

.

"

Legal sources assure that this modification

extends the protection to illegal occupation

, since it eliminates the possibility of suspending the stoppage of eviction even in the event of a crime.

However, from the

Ministry of Transport, Mobility and Urban Agenda they

deny this point and ensure that the intention behind the change is to extend the protection to minors and dependents when there are criminal proceedings in addition to civil cases underway for the occupation.

The same sources also explain that this exception will only apply in the case of

large holders

, that is, in the case of owners with more than 10 properties owned.

Never in the case of individuals or small owners.

From the real estate sector, for its part, they consider that introducing modifications in the decree that extends the suspension of evictions just three weeks after its approval increases the legal uncertainty that is being generated around the rent, and will generate a call effect of the illegal occupation that will harm both private and professional owners.
