  Reporter investigation: some second-hand trading platforms openly sell fakes

  In the “Regulations and Terms” of this second-hand trading platform, it is clearly stipulated that “no items that infringe the intellectual property rights or other legal rights of others shall be published or traded”, but reporters on the platform randomly input the keyword “high imitation lipstick” to search. It was found that a nominally high imitation lipstick was on sale and publicly declared that it was "exactly the same as the genuine one."

  The seller on this second-hand trading platform that sells the net red packet of the nominal Gucci "re-engraved version" told reporters that the so-called "re-engraved version" is actually a counterfeit product commonly known as "high imitation".

  On this second-hand platform, a product labeled "company-level re-enacted aj high-top sneakers", in the product details, the brand is marked as "Nike", and introduced "with appraisal, anti-theft buckle, flying small In further communication, the seller confessed to reporters that the shoes they were selling were "high imitations."

  On another second-hand platform, although most of the product names do not see products with the words "high imitation" or "re-engraved", the promotional pictures of some products caught the attention of reporters.

  In the product details of this nominal men's Longines watch, a picture with "precision imitation" was particularly noticeable. When the reporter asked how to buy it, the seller asked the reporter to communicate on WeChat.

Through this seller’s WeChat reporter, we learned that they are still selling fake products that are counterfeit famous brands.

  Jiangsu Provincial Consumer Protection Commission released a consumer survey on second-hand trading platforms 90% of consumers encountered problems

  The reporter found that the sale of fake goods is only one of the problems of second-hand trading platforms, and the problem of difficulty in protecting rights is also very prominent on the second-hand platforms.

The latest "Second-hand Trading Platform Consumption Survey Report" released by the Jiangsu Provincial Consumer Protection Committee shows that more than 93% of consumers said they encountered various problems in second-hand transactions.

  Not long ago, Ms. Huang from Nanjing, Jiangsu, bought a second-hand watch that was claimed to be a Cartier brand on a second-hand platform, but after receiving the goods, Ms. Huang found that this claimed brand-name watch seemed to be a bit problematic.

The texture of the watch is poor, the weight is relatively light, and the packaging is very cheap.

  Ms. Huang came to this second-hand platform again, and wanted to know if the Cartier watch she bought was real.

Contact customer service, but he can't be reached anymore.

Looking at the original product link, I found that the store no longer exists.

  Ms. Huang’s experience is not an exception. The Jiangsu Provincial Consumer Protection Commission used online questionnaires and consumer experience to conduct consumer surveys on online second-hand trading platforms, including Xianyu, Zhuanzhuan, Xianzhuan, Paipai, 58 same city, Find 12 second-hand trading platforms for all categories and non-all categories, including Liangji, Huafener, Xinshang, Zhier, Red Bollinger, Wanwatch, and Aihuihui.

  When the experience staff asked about the sale of fake products on the idle transfer platform, the platform customer service responded that there were fake products that could be reported, but if the seller indicated that it was a fake or a high imitation, the buyer would not mind, and also said that the genuine product will not be on this platform. buy.

Relevant experts pointed out that reaching an agreement between buyers and sellers does not mean that counterfeit and shoddy goods can be legally traded. The goods traded should comply with legal regulations. This is the bottom line.

  Zhao Xin, Director of the Supervision Department of the Jiangsu Consumer Rights Protection Committee: The platform clearly stipulates that the sale of fakes is prohibited, and if there is a sale of fakes, it will be dealt with accordingly, such as banning accounts, removing products, etc., but some platforms are found in the experience The act of selling fakes is even tacitly agreed.

  In this investigation, the Xianyu platform, Zhuanzhuan platform, and Xianzhuan platform have problems selling pornographic cartoons, pirated online courses, and audiovisual resources;

  Paipai platform recycling business has disputes such as low valuation and consumers' lack of autonomy in the transaction process;

  The specific rules for online recycling on the Liangji platform are ambiguous, the qualifications of quality inspection agencies are difficult to judge, and it is difficult for consumers to guarantee fair trading rights;

  The Huafener platform directly sells products marked with "high imitation", and there is a phenomenon of fake products posing as second-hand items, and the platform is suspected of acquiescing the sale of fakes.

  The Jiangsu Provincial Consumer Rights Protection Committee will conduct intensive interviews with the 12 second-hand trading platforms involved in response to the problems found in the investigation.

  Is the second-hand trading platform an "outside the law"

  The low registration threshold, the low cost of breach of contract, and the difficulty in raising evidence for rights protection have led to numerous consumer disputes on second-hand platforms.

However, second-hand trading platforms are not "outside the law." The essence of second-hand transactions is still selling goods or services through the Internet, which should also be subject to the "Consumer Rights Protection Law" and "E-commerce Law" and other relevant laws.

  In addition, relevant standards for Internet second-hand trading platforms should be promulgated as soon as possible to strengthen restrictions on industry supervision and illegal activities and consolidate platform responsibilities, purify platform information release content, from user entry, information release, publicity and promotion, transaction security, after-sales protection, etc. On the one hand, we will comprehensively control governance, raise the entry barrier, implement real-name certification, and strengthen seller qualification review.
