Measures for Nanjing Talents to Buy Commodity Housing: Falsified companies and talents will be disqualified

  In order to further expand the coverage of the talent purchase policy, and focus on solving the problem of purchasing commodity housing, which is generally concerned by talents, the General Office of the People's Government of Nanjing City, Jiangsu Province issued the "Nanjing City Talents Purchase Commodity Housing Measures" on January 15.

The new "Measures" will come into effect on the date of issuance.

  Compared with the 2020 version of the “Measures”, the 2021 version of the “Measures” adds a new classification of undergraduate talents under the age of 45, and clarifies on the basis of the old version that the master’s degree must have paid social security for 6 months in Nanjing, and the undergraduate must be in Nanjing paid social security for 12 months; those who cooperated with others to falsify and defrauded the "Talent Purchase Certificate" shall cancel the qualification of all talents of the enterprise to purchase houses; if fraudulent, cancel the qualification of talents to purchase houses, and take back the housing.

  In April 2020, Nanjing issued the "Ten Measures to Support and Promote the Employment and Entrepreneurship of College Graduates in Nanjing", which stated that talents under the age of 45 can settle down with a bachelor's degree certificate and have priority in buying houses.

The "Measures" support the upgrading of employment and entrepreneurship measures for college graduates, and relax the threshold for settlement; at the same time, undergraduate graduates of enterprises above designated size, high-tech enterprises, and registered new research and development institutions registered in Nanjing have no ownership housing in Nanjing And if there is no housing transaction record within 1 year, priority can be given to house purchase.

Graduates and above, undergraduates under the age of 45 (including those who have returned from abroad and part-time postgraduates) can settle in Nanjing with their academic certificates.

Those with a college degree under the age of 40 can settle down after working in Nanjing for half a year.

  Specifically, there are eight types of commercial housing supply objects in the new version of the "Measures", including those who work in Nanjing, which is equivalent to the A-E categories of the "Nanjing City Talents Housing Measures"; those who have obtained a doctorate degree; those who are registered in Nanjing Enterprise work, senior management talents and technical backbones with annual tax income of 500,000 yuan and above; and recommended talents recognized by the Nanjing High-level Talent Recommendation Committee and approved by the Municipal Party Committee and Municipal Government.

These four types of talents only need to sign a labor contract of one year or more with the unit and pay social insurance or personal income tax in Nanjing.

  Talents who have obtained a master's degree in registered and recognized enterprises above designated size, high-tech enterprises, and new-type research and development institutions in Nanjing; talents with a bachelor degree (under 45 years old); highly skilled talents with a senior technician or higher professional qualification; These three types of talents must meet the conditions for signing a labor contract of 1 year or more with their units. Those who have obtained a master's degree must pay 6 months or more of social insurance or personal income tax in Nanjing, and those who are under the age of 45 must pay 12 months.   The eighth category is other talents approved by the Nanjing Municipal Government.

  At the same time, the above supply objects are not limited to household registration, including overseas talents and talents from Hong Kong, Macao and Taiwan.

Nanjing's household registration is equivalent to high-level talented families of categories A, B, and C, who have no ownership housing or only one housing in Nanjing, can enjoy the talent purchase policy; other talents must apply for themselves, their spouses and minor children There are no houses with own property rights in Nanjing and no housing registration information and transaction records within one year.

  In the 2020 version of the "Measures", when applying for families with household registration equivalent to category A, B, and C talents in Nanjing, it is limited to only one house and the building area is less than 90 square meters.

  In addition, the new version of the "Measures" still requires good faith declarations for talent families applying for house purchases, but strengthens the supervision of house purchases due to fraud.

If it is found that there are acts of falsification, false reporting, concealment, or speculation of house numbers, the qualifications for purchasing houses shall be cancelled immediately, and those who have not purchased houses shall cancel their "Certificate of House Purchase by Talents", houses that have been selected or subscribed shall be recovered, and those who have signed contracts shall not be subject to contract recordation .

At the same time, it is not allowed to apply for the talent purchase policy within 2 years, and the serious circumstances will be recorded in the integrity file and the corresponding legal responsibility will be investigated.

  On this basis, the new version of the "Measures" has increased the requirements for enterprises.

Enterprises should earnestly fulfill their main responsibilities, promise to be responsible for the authenticity of their talent purchase declarations, and cooperate with others to falsify and defraud the "Talent Purchase Certificate", cancel the qualifications of all talent purchase applications of the enterprise, and incorporate it into the enterprise credit investigation system and publish it to the public. If the circumstances are serious, the enterprise shall be investigated for legal responsibility.

  Chapter One General Provisions

  Article 1 In order to thoroughly implement the spirit of General Secretary Xi Jinping’s important instructions on talent work, in accordance with the overall requirements of the municipal party committee and municipal government’s talent settlement work, continuously improve the accuracy and effectiveness of policy measures, further expand the coverage of talent purchase policies, and focus on solving talents. These measures are specially formulated for the purchase of commercial housing that is of general concern.

  Chapter 2 Supply Target

  Article 2 The supply object shall meet one of the following conditions:

  (1) Working in our city is equivalent to the A-E talents in the "Nanjing City Talents Housing Measures", signing a labor contract of 1 year or more with the unit, and paying social insurance or personal income tax in our city.

  (2) Talents who work in our city and have obtained a doctorate degree must sign a labor contract of 1 year or more with the unit and pay social insurance or personal income tax in our city.

  (3) Talents who have registered in our city and have been certified to work in enterprises above designated size, high-tech enterprises, and new-type research and development institutions, and who have obtained a master's degree, sign a labor contract of 1 year or more with the unit, and pay in our city for 6 months or more Social insurance or personal income tax.

  (4) Talents who have obtained a bachelor degree (below 45 years of age) who are registered in our city and work in enterprises above designated size, high-tech enterprises, and new-type research and development institutions that have been registered in our city, sign a labor contract of 1 year or more with the unit, and pay in our city Social insurance or personal income tax for 12 months and above.

  (5) High-skilled talents who have been registered in our city and have been certified to work in enterprises above designated size, high-tech enterprises, and new-type research and development institutions, and have obtained senior technicians and above vocational qualifications, have signed labor contracts of 1 year or more with units, and work in our city Pay social insurance or personal income tax.

  (6) Senior management talents and technical backbones who work in enterprises registered in our city with an annual tax income of 500,000 yuan or more, sign a labor contract of 1 year or more with the unit, and pay social insurance or personal income tax in our city.

  (7) Working in our city, the recommended talents who are recognized by the Nanjing High-level Talent Recommendation Committee and approved by the Municipal Party Committee and Government shall sign a labor contract of 1 year or more with the unit and pay social insurance or personal income tax in the city.

  (8) Other talents approved by the municipal government.

  The above supply targets are not limited to household registration, including overseas talents and talents from Hong Kong, Macao and Taiwan.

  Chapter III Application and Review

  Article 3 Talents apply online through the "My Nanjing" APP or the "Nanjing Real Estate WeChat Official Account" WeChat official account.   Article 4 The municipal and district two-level organizations, development and reform, science and technology, industry and information, human resources and social security, real estate, investment promotion, taxation and other departments are responsible for the review work.

  (1) Working in our city is equivalent to the A-E talents in the "Nanjing City Talents Settlement Measures", and is reviewed with reference to the division of responsibilities recognized by the "Nanjing City Talents Settlement Measures".

  (2) Talents who work in our city and have obtained a doctorate degree will be reviewed by the human resources and social department.

  (3) Those who are registered in our city and work in enterprises above designated size, high-tech enterprises, and new-type R&D institutions, who have obtained a master’s degree, have obtained a bachelor’s degree, and have obtained high-skilled personnel with a senior technician or above The Ministry of Human Resources and Social Security conducts review.

  (4) The senior management personnel and technical backbone of enterprises with annual tax income of 500,000 yuan and above who work in enterprises registered in our city shall be reviewed by the taxation department.

  (5) The recommended talents who work in our city and are recognized by the Nanjing High-level Talent Recommendation Committee and approved by the Municipal Party Committee and Municipal Government will be reviewed by the Human Resources and Social Security Department.

  (6) For other talents approved by the municipal government, the district talent settlement office shall conduct a preliminary review, and the municipal talent settlement office shall summarize the review opinions and report to the municipal government for approval.

  Article 5 In principle, the application submitted by talents will be reviewed and approved within 7 working days. Those who have passed the review will be given a "Certificate of Talent Purchase" with a validity period of 1 year. Those who are overdue must apply again.

  Chapter 4 Supply of Housing

  Article 6 The government raises real estate directionally.

According to the demand for talents, combined with the project listing situation, the batch or overall raising is specified in the project sales plan.

  Article 7 The market gives priority to the supply of housing.

The city's saleable commercial housing is given priority to talents. Each batch of supply houses is 20%-30% of the sales volume of this application. The specific number is determined by the development company in the project sales plan according to the talent needs.

  Chapter 5 Supply Method

  Article 8 The centralized supply of housing oriented by the government.

According to the different characteristics of each project, combined with the location, type, price and other factors to formulate a separate sales plan, in the plan to specify the supply of housing, quantity, price, objects and other content and publicize it to the public, talents rely on the "talent purchase certificate" Register at the project site, and the government-designated unit or development company will organize talents to select houses in a centralized manner according to the sales plan.

  Article 9 The listings given priority to the market shall be supplied in batches.

According to the project opening plan, the municipal real estate department publishes the commodity housing information and the contact information of the service specialists on the "Nanjing City Talent Housing Information Service Platform". The talents can register on the project site with the "Talent Purchase Certificate", and the development company is handling the pre-sale After the permission (for the record of current sale), in accordance with the principle of "talent priority, open process", according to the publicized sales plan, organize talents and other buyers to select houses simultaneously.

  (1) Projects that require lottery.

After the relevant development companies have processed the commercial housing pre-sale license (sales record), they will determine the sequence number of talent selection through lottery or lottery, and determine the shortlist of talents based on 20%-30% of the project’s current sales volume. Talents are given priority, and other house buyers are organized in order to organize house selection.

Talents who are not shortlisted are not included in this batch of talent selection. This part of talents can sign up for other buyers' lottery or wait for the opening of the next phase of housing. They can also choose other commercial housing within the validity period of the "Talent Purchase Certificate".

  (2) Projects that do not require lottery.

After the relevant development companies have processed the commercial housing pre-sale permit (sales record), according to the sales plan, the selection of houses will be organized in the order of talents first and other buyers progressive.

  Those who give up during the house selection process can still apply for other commercial housing projects within the validity period of the "Talent Purchase Certificate", and the abandoned houses will be successively selected by other house buyers.

  Chapter VI Supervision and Management

  Article 10 Development enterprises shall, in accordance with the requirements of these Measures, formulate detailed sales plans, provide services such as daily reception, demand registration, and public announcements, and organize house selection, subscription, payment, and contracting in accordance with relevant regulations and requirements of the real estate sales industry. Sales work, standardize sales behavior, and ensure the smooth and orderly progress of sales work.

  Article 11 In the process of house sales, talents and development companies shall perform their respective obligations in accordance with the agreement signed by both parties, and the performing party shall have the right to deal with or hold the breaching party liable in accordance with the agreement.

  Article 12 Financial institutions are encouraged to provide preferential and convenient financial services for talents.

In principle, the real estate raised by the government will be supplied to qualified talents at a preferential price and a lower down payment ratio.

  Article 13 The municipal publicity department is responsible for the publicity and guidance work; each district talent settlement office shall do a good job in the policy publicity work within its jurisdiction, and be responsible for the policy advisory services in the district; municipal development and reform, science and technology, industry information, investment promotion, etc. The competent authorities of the industry should follow the guidance of “conducive to the construction of innovative cities, conducive to the accumulation of outstanding talents, and conducive to the development of leading industries”, and cover the policies to enterprises, especially high-tech enterprises, industrial enterprises above designated size, new research and development institutions, and investment promotion Key projects, etc., to ensure that policy coverage does not leave dead ends.

  Article 14 Each talented family can only enjoy the talent purchase policy once and can only purchase one set of housing. When going through the registration, house selection, subscription, payment, signing and other procedures, the person must hold the Talent Purchase Certificate.

Newly-built commercial housing or stock commercial housing can be purchased with the "Talent Purchase Certificate", and the purchased housing cannot be transferred within 5 years.

  Article 15 An enterprise shall earnestly perform its main responsibility, promise to be responsible for the authenticity of its talent purchase declaration, and cooperate with others to falsify and defraud the "Talent Purchase Certificate", cancel the qualification of all talent purchase applications of the enterprise, and incorporate it into the enterprise credit investigation system as required. If it is announced to the public that the circumstances are serious, the enterprise shall be held liable.

  Article 16 Talents shall declare in good faith and submit relevant materials truthfully when applying for house purchase services.
