The National Markets and Competition Commission (CNMC) has proposed to the Government that it include

influencers

in a clear definition of "audiovisual communication service providers that are supported by video exchange platforms."

The Spanish Competition authority has published its report on the Draft General Law on Audiovisual Communication and calls on those responsible for the Ministry of Economy and Digital Transformation of Nadia Calviño to establish "

specific rules

for providers of audiovisual communication services that are supported on video exchange platforms, such as certain

influencers

. "

As the CNMC warns, "new forms of audiovisual services have emerged whose nature has not been easy to identify", among which are those "grouped under the concept of

influencers

or

opinion prescribers

."

Competition therefore highlights the need to classify some of these agents

as providers of audiovisual services so that they face the regulations

and do not remain outside the law.

"Until the relevant regulatory development is carried out, these providers must only comply, in addition to the general principles of audiovisual communication, to the specific obligations of protection of minors and consumer protection", they state in the CNMC for a gradual integration.

"The new Audiovisual Law has a vocation of permanence of at least another 10 years and it is more than foreseeable that in this period of time

these incipient agents will be more established and their role will be more decisive

. Thus, their inclusion in the regulatory framework is more than recommendable ", indicates the report of the CNMC, released this Wednesday.

The CNMC has analyzed YouTube, Instagram TV, TikTok and Twitch to verify the activities of so-called influencers and the "possible presence of content that could violate the LGCA [the General Audiovisual Communication Law that currently governs] for not complying with some of the measures on commercial communications, such as the

lack of identification of advertising, or on the protection of minors

, such as the age rating in content not suitable for all audiences ".

Limits for platforms like Netflix

The future General Law of Audiovisual Communication intends that the new platforms are not left out of the obligations that the Spanish television channels must assume.

Thus, the text suggests that these service providers, such as Netflix, HBO, Amazon Prime Video or Disney +, dedicate

5% of their income in this country to financing European work

, and that at least 70% of that sum is destined to independent productions.

However, some companies such as YouTube (Google) are also free of these financial responsibilities, having been classified as a video exchange service and not as a provider of audiovisual services.
