  In December 2019, Wu Moumou, who was unemployed at home, accidentally saw someone on the Internet selling software to increase the traffic in the live webcast room, and remembered his old classmate Yao who is good at programming.

"If you can develop a similar software yourself, wouldn't it be a profitable business?" Wu Moumou immediately contacted Yao, and the two immediately got together to plan a share of the live broadcast boom.

Under Wu's instructions, Yao developed a "live broadcast artifact" to inflate the traffic in the live broadcast room of an e-commerce platform.

After several revisions and upgrades, in February 2020, Yao delivered a software that integrates the functions of importing trumpets in batches, virtual increasing the number of viewers, collecting numbers, speaking interaction and other functions to Wu Moumou, and received several benefits.

After that, Wu became a sales and customer service and actively "exploited" the market. In addition to selling the software on a certain platform, he also peddled the software to merchants through small advertisements in the live broadcast room.

  This method of secretly swiping traffic is simple to operate. After the merchant downloads the software and registers the account, purchase the card secret to recharge the account. Different numbers of card secrets correspond to the different levels of activity in the live broadcast room. The more card secrets purchased, the live broadcast room The data will become more "prosperous."

In order to increase the popularity and sales of the live broadcast rooms of their stores, and thus attract more people to buy goods, many merchants actively contacted Wu.

When the live broadcast, merchants “plug-in” this software, there will be “zombie fans” enthusiastically interacting with the anchor, creating a false lively scene, and some “melon-eating crowds” who don’t know the truth follow the trend.

The merchant confessed that after such an operation, store sales have indeed risen, and bringing goods has become easier than before.

In just over three months, nearly 200 merchants came to the door, and Wu and Yao easily made more than 32,000 yuan.

  Criminals and merchants joined forces to make profits, but platforms and consumers suffered as a result.

It has been identified that this program has unauthorized acquisition, addition, and modification of the transmission data of the computer information system, which is a destructive program.

It not only affects the normal operation of the e-commerce platform information system, but also seriously undermines the market environment of fair competition.

In addition, because consumers often purchase products based on the number of fans of the anchor and the popularity of the live broadcast room when shopping online, the cheating behavior of stealing traffic can also cause great misleading to consumers.

  After review, the Changning District Procuratorate found that Wu and Yao provided others with programs to invade and illegally control computer information systems. The circumstances were particularly serious and should be investigated for criminal responsibility for the crime of providing programs to invade and illegally control computer information systems.

In the end, the court sentenced the defendant Wu to three years and two months in imprisonment and fined 5,000 yuan for the crime of providing intrusion and illegal control of computer information system programs; and Yao was sentenced to three years and one month in prison and a fine of 2,000 yuan. .

A few days ago, because the two defendants filed an appeal, the case entered the second instance procedure.
