 Lending venues and borrowing contracts "high income and low rent"

  In August last year, Shanghai resident Chen Li (pseudonym) was interested in renting a house. An agent who claimed to be Macalline Aijia Deng Zhenzhen contacted her and asked her to sign a contract at Macalline Aijia Dongbo Road store.

  Deng Zhenzhen showed Chen Li the intermediary service contract numbered 0005340 and the house lease contract provided by Shanghai Fuyi Real Estate Brokerage Co., Ltd. (hereinafter referred to as "Fuyi Company"), which agreed to rent for one year at a price of 4000 yuan per month .

  "Red Star Macalline is a big brand, I think Fuyi is a long-term rental apartment brand under Red Star Macalline, otherwise I would never sign a contract." Chen Li recalled that the whole process went very naturally, and there were no people in the store. Questioned the identity of Deng Zhenzhen, "He also used the in-store computer to help me make a supplementary contract."

  After signing the contract, Deng Zhenzheng asked Chen Li for 3,500 yuan on the grounds of distributing furniture and home appliances, and made a checklist to be included in the contract appendix. He also asked Chen Li to copy the contract on the grounds that Chen Li was far away. Bring the document back and read it carefully. If there is no objection, Deng Zhenzhen will sign the contract on behalf of the company, and pay the Macalline Love Home agency fee, which will be transferred by Deng Zhenzhen, in order to practice the service concept of "less customers run away".

  Ironically, Chen Li later discovered that Deng Zhenzhen was not a Fuyi salesperson, nor was he a Macalline Aijia agent, and even had no intermediary service qualifications at all. He just borrowed the venue of Macalline Aijia Dongbo store.

  "In less than two months after signing the contract, Fu Yi ran away." So far, Chen Li's house has been subletted several times, and the use and structure of the house have been changed. She has also fallen into the predicament of nowhere to defend her rights.

  After Fuyi Company ran off, Deng Zhenzheng confessed that the company adopted a "high income and low rent" model, and adopted a method of significantly lower than market price to tenants, tempting them to pay rent for one year or more at one time, and then they pretended to be "Blasting Thunder" took money and ran away.

The cost of illegality is low, and the intermediary is confident

  In response to fake brokers’ acts of borrowing venues and using fake contracts to deceive customers, Macalline Aijia denied in January this year that it had a cooperative relationship with Fuyi Apartment and that it provided relevant intermediary services to customers.   The person in charge of an intermediary store revealed that the Fuyi salesperson will receive a commission of 10,000 yuan for each set of real estate.

"Now there are many platforms that deliberately defraud in the market. Under the guise of long-term apartment rentals, they use the power of some illegal intermediaries to'high income and low rent', and then make money and run away, and give them'help' to cheat them. Intermediaries must be divided."

  At present, both the registered place of Fuyi and the actual office address have been empty, and the number of victims of the company's "thunder explosion" has reached 1,000.

  In fact, since 2018, long-term rental apartment platforms have been "thundering" frequently.

According to statistics from Tianyan Check, there are currently about 170 long-term rental apartment-related companies that have been cancelled or revoked across the country, accounting for 15% of the total number of related companies.

  Judging from the "explosive" situation, with the exception of some brand apartments that have broken the capital chain due to poor management or blind expansion, many long-term rental apartment platforms are established for the purpose of making money and running away. The fraudulent methods are the same.

  Attorney Ding Xingfeng, a partner of Shanghai Chuangyuan Law Firm, believes that salespersons and intermediaries are the key link in many long-term rental apartment frauds. The police should take them as the key link of the entire fraud to "find it through", impose heavy fines and pursue them. Responsibilities of intermediary agencies and salespersons are particularly effective.

 Why can frauds always "copy and paste"

  There are many supervisory departments involved in long-term rental apartments. After the "explosion", the situation of "anyone can manage, but no one wants to control" often appears, leaving landlords and tenants with "a piece of chicken feathers", and even more relevant intermediaries and long-term rentals. The apartment platform and the brokers who "helped the abuser" are at large, constantly "copying and pasting" fraud.

  The reporter learned from the Economic Investigation Brigade of Pudong New Area in Shanghai that the "thunder explosion" incident of Fuyi Company that ran off at the end of September last year has not been filed.

The local police station considers it to be a “contract dispute, and judicial procedures are recommended.”

  In large cities such as Xi’an, Shenzhen, Beijing, and Chengdu, recently there have been cases of malicious circumvention of long-term rental apartments. Some regulatory authorities ignore the landlord for reasons such as being unable to rely on it, negotiating for lease disputes, and difficult to define malicious business behaviors of enterprises. And the phenomenon that the legitimate rights and interests of tenants are violated.

  In October 2020, the long-term rental apartment operator headquartered in Xi'an, "City Finding a House" maliciously "exploded with thunder" and ran away. After some defrauded landlords and tenants complained to multiple parties, the problem has not been resolved so far.

  After the long-term rental apartment company "Zuoqi" ran off in 2019, hundreds of deceived landlords and tenants visited public security, housing construction and other departments, but "the police station recommended to go to the court for litigation" and the housing construction department recommended to go to the investigation report. , The Consumers Association claimed that "lack of jurisdiction over housing leasing"...wandering around, the problem has not yet been resolved.

  The reporter found that the scammers run away, and those who "behave for the tiger" have almost no illegal costs, and the whole society has to "pay for the scam" tragedy repeated, so that the industry's "small evil" has become a social problem.

  Hu Jinghui, chairman of Beijing Xiangchu Zhaohui Enterprise Management Co., Ltd., believes that, looking at the "thunder explosion" cases in recent years, the perpetrators only need to make money and run away, and the executives bear civil liability at most, such as being restricted from high consumption.

"The cost of illegality is low and the benefits are huge. This will allow more unscrupulous companies to exploit loopholes and read wrong scripture."

  Industry insiders such as Zhou Junqiang, CEO of Weiterangdi Community, believe that regulatory authorities should strengthen pre- and post-mortem supervision, and impose heavy penalties on the instigators and “believers” in order to behave like others and solve the pain points of renting in big cities.

  Ding Xingfeng believes that judicial organs should strictly enforce the law and cannot reduce the fraud of housing leasing to breach of contract in civil disputes. Instead, the cost of illegal and criminal activities in the field of housing leasing should be increased to form a powerful deterrent in the industry and effectively protect the rights and interests of the people.
