Hyundai Heavy Industries placed over 48,000 orders to 207 subcontractors over the past four years from 2014 and was issued a contract late, and was imposed a penalty of KRW 20.8 billion from the Fair Trade Commission.



The'pre-construction and post-construction contract' is a chronic unfair subcontracting transaction in the shipbuilding industry that is written after the work is done.



Samsung Heavy Industries also received a penalty of KRW 3.6 billion for similar subcontracting in April.



However, the FTC did not issue a'payment order' to the two companies to compensate their subcontractors for outstanding payments.



This is because the standards became stricter when the Supreme Court put a brake on payment orders in 2016.



The Fair Trade Commission ordered STX Offshore & Shipbuilding, which reduced the subcontracting cost in 2016, to pay 259 million won to subcontractors.



However, the Supreme Court judged that "there is a lack of grounds to view the existing delivery price suggested by the FTC as a'fair delivery price'."
