  Disputes arising from online transactions

  Zhao Moumou is the owner of an Anhui company. In May 2017, Zhao Moumou purchased a batch of wood from Suzhou to be shipped to Anhui.

Zhao Moumou asked the seller to help him release an order on an online platform. Zhao Moumou and Wang Moumou received the order online, and the two parties agreed that the shipping fee was 4500 yuan.

Later, due to one night delay in loading, Zhao and Wang proposed to add 200 yuan as a delay fee, and Zhao promised to pay the goods together after they arrived.

  According to normal circumstances, Zhao could receive the goods that night, but he did not receive it.

Because the cargo was two tons overweight, Zhao and Wang decided to ask Zhao for more money. They fabricated the traffic police and found out that they needed a fine to ask Zhao for more money. They were refused, and the two directly transferred the goods.

In order to get the goods back, Zhao Moumou promised Zhao Moumou and Wang Moumou to pay a total of 10,200 yuan for the carriage fee, fine, overweight fee, warehouse fee, and unloading fee.

Zhao Moumou immediately called the police after receiving the goods, and soon the two were arrested by the police.

After the trial by the Xiangcheng District Procuratorate, they believed that Zhao and Wang's actions constituted the crime of extortion, and prosecuted the two according to law.

The two were sentenced separately.

  The prosecutor reminded: Some lawbreakers use non-performance of the contract, non-delivery of goods and other reasons as bargaining chips to force business owners to submit. For this reason, companies must strengthen risk prevention when conducting online transactions, pay attention to verifying the identity and business qualifications of the other party, and improve the contract as much as possible Terms, after a transaction dispute occurs, first negotiate with the other party to resolve it or complain to the online platform. If the negotiation fails, you must report to the police in time to avoid property losses.

 Resent companies for unfairly stealing secrets and revenge

  Fan XX is an employee of a company in Suzhou. Due to the adjustment of the company's department, Fan XX was dissatisfied with the new position of the company. He felt resentment. First he failed to report the company's commercial bribery, and then he personally went to Shantou, Guangdong, where the company’s headquarters is located. He falsely claimed to report bribery and tax evasion by the head of the headquarters, tricked the headquarters courier into privately unpacking the express parcels, and obtained the documents between the Suzhou company and the headquarters.

  Fan Moumou returned to Suzhou and directly confronted the person in charge of the Suzhou company, threatening to obtain trade secrets and demanding payment of 6 million yuan.

The person in charge of the Suzhou company was worried that the company’s secrets would be leaked and would affect the company’s reputation.

Later, the person in charge of the Suzhou company could not bear all kinds of harassment by Fan XX and was forced to choose to report to the police.

In January 2019, Fan Moumou was sentenced to 8 years in prison for extortion and fined RMB 50,000.

  The prosecutor reminded: Some private enterprises have weak awareness of prevention, loose internal management, and business secrets stolen by lawbreakers, causing great trouble to the production and operation of the enterprise, and may even cause a devastating blow to the enterprise if handled incorrectly.
