The Rental Dispute Settlement Center, the judicial arm of the Dubai Land Department, obligated a tenant to pay 250,000 dirhams a cooling bill for a six-month depreciation period.

The center stated, in a court ruling, which "Emirates Today" reviewed, that the case belongs to one of the companies (the tenant), in addition to the check writer in the case, affirming the joint liability in this case for both the check writer and the original tenant.

In detail, the Rental Dispute Settlement Center, the judicial arm of the Dubai Land Department, confirmed that the tenant is obligated to pay all fees and taxes due on the use of the property to government agencies and departments, including service fees, indicating that this came in the content of a recent rental ruling. Case details

The center explained that the case belongs to one of the companies (the original tenant whose name is the contract) and another person, who is the check writer, for a lease contract worth three million and 180 thousand dirhams in return for the rent for the period from February 1, 2020 to January 31, 2021.

He added that the landlord (the plaintiff )’s requests focused on obligating the tenant to value checks and service fees, pointing out that Law No. (26) of 2007 amended by Law No. (33) of 2008 regarding the regulation of the relationship between lessors and tenants of real estate in the Emirate of Dubai, stipulated that «must The lessee has to pay the rent allowance on its due dates. In addition, unless the lease contract stipulates otherwise, the tenant is obligated to pay all fees and taxes due on the use of the property to government agencies and departments.

Judgment

The center stated that the committee hearing the case ruled (first) to oblige the two defendants (the charter company and the check writer) to jointly pay the value of checks amounting to 795 thousand dirhams as rental value for the period from May 1, 2020 to October 31, 2020.

Secondly, the committee decided to oblige the first defendant (the original tenant) to pay the amount of 250 thousand dirhams for the value of refrigeration consumption for the period from February 1, 2020 to July 31, 2020, in addition to the new value of refrigeration consumption until the date of this ruling.

The tenant is obligated to pay the fees and taxes due on the use of the property to government agencies and departments.
