Empresas.Dentix requests a bankruptcy since it cannot face its debt
The chain of dental clinics,
Dentix
, has announced that it will
file for bankruptcy
since it cannot cope with the debts incurred.
This has led to clients who had contracted services with the firm
not receiving treatment and losing everything invested
.
It is going to be
difficult for Dentix customers to get their money back
.
According to the Bankruptcy Law, consumers
are the last on the list in a bankruptcy.
To this is added that the company will not be able to pay more than a small percentage of the debt, according to the Organization of Consumers and Users (OCU).
However,
there are certain clients who have a better chance of getting the money paid back
.
These are
those that had their treatment linked to some type of financing
, since the claim, in this case, would be directed against the entity that has financed, not against Dentix.
FACUA-Consumidores
en Acción
denounces the inaction of the Government
: "More than two years after the iDental scandal broke out, neither the previous Executive of Pedro Sánchez nor the current one have made any type of modification of the regulations that regulate dental clinics to
ensure the protection of consumer rights
in this sector of activity and with a
business model linked to financing contracts
. The most urgent, the requirement of civil liability insurance ".
In 2018, it broke the IDental chain of clinics and left 20,000 patients with their dental treatments unfinished.
Two years earlier, the Vitaldent and Funnydent stores had ceased all activity, leaving hundreds of customers in a similar situation.
Back then, FACUA demanded that the Government "tighten the Administration's controls on these clinics."
Regarding possible solutions for consumers, OCU lawyers are studying
formulas that allow those affected to recover most of the money
invested in their treatments or the search for alternatives for completion.
For its part, FACUA seeks that the authorities impose "effective controls that entail exemplary sanctions" to avoid similar events in the future.
Dentix
, who contracted debts with KKR, BBVA and Cetelem,
blames the KKR fund
for the situation to which it has been led and recalls the breach of its investment agreement.
To save the situation, the firm has started a negotiation process with its main financial creditors in order to
refinance the existing debt
and obtain an injection of funds, and on the other hand it opened a search process for new investment partners.
