Xinhua News Agency, Shanghai, September 26 (Reporter Guo Jingdan) The 25th meeting of the Standing Committee of the 15th Shanghai Municipal People’s Congress voted on the 25th to pass the "Shanghai Municipal People’s Congress Standing Committee on Promoting and Guaranteeing the Demonstration of the Development of Ecological Green Integration in the Yangtze River Delta "Decision on Several Issues in District Construction", this decision authorizes the Demonstration District Executive Committee to exercise provincial-level project management authority to uniformly manage cross-regional projects in accordance with the relevant regulations of Shanghai, Jiangsu and Zhejiang.
On September 24 and 25, the Standing Committees of Zhejiang and Jiangsu Provincial People’s Congresses also successively passed relevant decisions on the construction of the demonstration zone. This is the first time that the Standing Committees of the People’s Congress of the two provinces and one city have made simultaneous legal decisions on the construction of the demonstration zone. It maintains a high degree of consistency with the content and provides a strong legal guarantee for the implementation of the "Overall Plan for the Yangtze River Delta Ecological and Green Integrated Development Demonstration Zone".
Adhering to this concept of not breaking administrative subordination and breaking administrative boundaries, Shanghai has made a clear decision. The Demonstration Zone Council jointly established by Shanghai, Jiangsu Province and Zhejiang Province, serves as a decision-making platform for important matters of demonstration zone construction and is responsible for research and determination of demonstration zones. Construction development plans, reform matters and supporting policies, coordinate and promote major projects.
A total of seven articles have been decided, of which article 5 is the core clause, which is to authorize the executive committee of the demonstration zone to exercise provincial-level project management authority, to uniformly manage cross-regional projects in accordance with the relevant regulations of the people’s governments of the two provinces and one city, and to be responsible for the first start of the zone. For the approval, approval and record management of cross-regional investment projects outside the regulations, the People's Government of Qingpu District, Shanghai, Wujiang District, Suzhou City, Jiangsu Province, and Jiashan County, Zhejiang Province shall exercise the right to approve the first-initiated district control detailed planning.
The decision also provides for government and departmental support and legal protection. It clarifies that in the demonstration zone, Shanghai's local laws and regulations are inconsistent with the overall plan and need to be adjusted and implemented by the Shanghai Municipal People's Congress Standing Committee to make a decision according to law; If measures such as integration system innovation and major reform integration require temporary adjustments or temporary suspension of the implementation of Shanghai’s local laws and regulations, the Demonstration Zone Executive Committee may make recommendations to the Shanghai Municipal People’s Congress Standing Committee, which will be determined by the Shanghai Municipal People’s Congress Standing Committee according to law.
