Hamdan bin Mohammed issues a decision regarding tourist camps in Dubai

His Highness Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai and Chairman of the Executive Council of the Emirate of Dubai, issued Council Decision No. (24) of 2020 regarding tourist camps in the Emirate of Dubai, with the aim of strengthening the emirate's position as a tourist destination in the establishment and operation of tourist camps, and the regulation of the practice of their establishment Managing and operating it in the emirate, in accordance with the best international practices followed in this regard, and raising the level of services provided in the tourist camps.

The provisions of this decision apply to all tourist camps in the Emirate of Dubai, including the camps that are established, managed and operated within the Special Development Zones and free zones, including the Dubai International Financial Center.

The department's terms of reference

According to the decision, the Department of Tourism and Commercial Marketing in Dubai is the competent authority in the emirate to regulate the establishment, management and operation of tourist camps, and its powers in this regard include: setting the conditions, requirements, procedures and standards necessary for practicing this activity in the emirate, and determining the minimum level of tourism services that must be available in the tourist camps. According to the category of the tourist camp, and in accordance with the best practices followed in this regard, and to decide on the applications submitted to it by the establishments to conduct the activity in the emirate.

The department also supervises the practice of establishing, managing and operating tourist camps in the emirate, in accordance with the provisions of this decision and the decisions issued in pursuance hereof, and overseeing and inspecting the tourist camps, and the workers therein, to ensure that the requirements, requirements and standards that must be provided in the tourist camps and the tourism services and services are met. According to the categories of tourist camps defined in accordance with the provisions of this resolution, as well as receiving complaints against tourism facilities, investigating these complaints and taking the necessary measures in their regard, imposing administrative penalties stipulated in this decision on violators of its provisions, and establishing a database of tourist camps that are set up in the emirate. .

According to the decision, any individual or entity is prohibited from practicing the activity related to establishing, managing and operating tourist camps in the emirate before obtaining the permit, provided that the executive regulations of this decision specify the conditions and procedures for issuing and renewing the permit, and it is also prohibited for the tourism establishment to conduct the activity in places other than those specified by the Department. The decision specified the duration of the activity permit, the mechanisms for assigning it, the classification of tourist camps according to the level and type of tourism services, the amendment of the category of the tourist camp classification to a higher or lower category, and its location that is determined by the Department of Tourism and Commercial Marketing in Dubai.

Tourism obligations of the facility

The decision stipulates that any individual company or establishment authorized by the Department of Tourism and Commercial Marketing in Dubai to engage in the activity of establishing, managing and operating tourist camps - with a number of obligations, including: the legislation in force in the emirate, including the provisions of this decision and its executive regulations and the decisions and instructions issued pursuant to them And adherence to the terms and scope of the permit, the tourist camp classification category, the requirements, conditions, standards, type and level of tourism services for the tourist camp classification category, specified in accordance with the provisions of this decision and its executive regulations, and the decisions and instructions issued in accordance with all the data and requirements of the department, and the decisions and instructions issued pursuant to which all the data and regulations contain. Tourism and commercial marketing in Dubai, updating them on a weekly basis, keeping these records and making them available to the department's employees for viewing upon request.

The obligations of the tourist establishment also include: adherence to the maximum capacity for the tourist camp according to its classification category, and not to change the tourist camp location before obtaining the prior written approval of the Department of Tourism and Commercial Marketing in Dubai and the relevant authorities in the emirate, and not to operate the tourist camp in the event that a decision is issued by the department or parties. The concerned emirate in the emirate to suspend its activity, and the tourist establishment is committed to fulfilling all contractual obligations towards visitors, documenting all tourism services that are provided in the tourist camp, and providing visitors with correct and complete data about the tourism services in the tourist camp, the conditions for their use, and responding to complaints referred to it. The department within the deadline it sets, and adhering to all instructions issued by the concerned authorities regarding security aspects, public health and safety requirements, ambulance and evacuation in the tourist camp.

The property is also obligated to register the data of its workers in the tourist camp, to provide the Dubai Department of Tourism and Commerce Marketing with this data and any modification that occurs to it, and to provide electricity, water and sanitation services to the tourist camps without any additional costs for the visitor, and to provide the department with the data, documents, documents and statistics that you require, and cooperation Complete with her and her employees, and obtain the department's prior approval before proceeding to change any data, documents or documents related to the permit or its commercial licenses.

Administrative offenses and penalties

According to the decision, whoever commits any of the violations specified in the attached table shall be punished by the financial fine indicated against each of them, provided that the value of the fine is doubled in the event of re-committing the same violation within one year from the date of committing the previous violation, and in a manner that does not exceed its maximum Fifty thousand dirhams, and in addition to the fine penalty, the Dubai Department of Tourism and Commerce Marketing may take one or both of the following measures against the violator, which are: suspension from practicing the activity for a period not exceeding six months, or cancel the permit, and notify the competent commercial licensing authority.

The provisions of this decision do not prejudice the imposition of any penalties, measures or other compensation stipulated in the legislation in force in the emirate, in the event that the practice of the tourism facility of the activity results in harm to the environment, health, public safety, or public or private property.

The Department of Tourism and Commerce Marketing in Dubai may, upon a written request submitted to it by the tourist establishment whose permit has been canceled, issue a new permit after one year has passed from the date of the cancellation of the permit, and the new permit shall be issued in accordance with the procedures and controls specified by the executive regulations of this decision.

The decision stipulates that everyone who has an interest may submit a written grievance to the Director General of the Department of Tourism and Commerce Marketing in Dubai regarding the decisions, procedures and measures taken against him under this decision and its executive regulations and the decisions and instructions issued pursuant to them, within fifteen days from the date of being notified of the decision, measure, or measure grieved against, and the grievance is made. In this grievance within thirty days from the date of its submission, by a committee set up by the director general of the department for this purpose, and the decision issued in this grievance is final.

The Department of Tourism and Commerce Marketing in Dubai, in order to implement the provisions of this decision and its executive regulations, and the decisions and instructions issued pursuant to them, may seek the assistance of government agencies in the emirate, and these authorities must provide assistance and assistance to the department as quickly as possible when requested to do so.

All individuals and entities who engage in the activity of establishing, managing and operating tourist camps in Dubai at the time of the implementation of this decision must adjust their conditions in accordance with its provisions, within six months from the date of its implementation, and the Director General of the Department of Tourism and Commerce Marketing in Dubai may extend this deadline for a similar period when necessary.

The Director General of the Department of Tourism and Commerce Marketing in Dubai issues the executive regulations and decisions necessary to implement the provisions of this decision, and they will be published in the Official Gazette of the Dubai Government.

Regulation No. (4) of 2006 regarding land-based tourist camps shall be canceled, and any text in any other decision shall be canceled to the extent that it contradicts the provisions of this decision and is published in the Official Gazette, and shall be enforced from the date of its publication.
