  Whenever the graduation season, a large number of "rental whites" flood into the rental market, it is difficult to resist the "traps" set by some black intermediaries. In the face of "bait" such as discounts and loans, many graduates are "confused" into the "pit".

  Experts suggest that lessees should increase their legal awareness and learn to identify "routines" in contracts. At the same time, relevant departments should establish long-term regulatory mechanisms to guide the development of the industry.

Clever words make the "routines" continuous under the color

  "When I saw the house, I agreed that the monthly rent was 1,400 yuan, but when signing the contract, an additional monthly property fee of 50 yuan was added." Wang Peng, who rents in Yunyan District, Guiyang City, started looking for a house after graduating from university this year. He said that when he chose personal listings in 58 same city, he found out that they were mostly intermediary companies.

  Some graduates told reporters that many intermediary companies made a lot of talk when they showed up, but after signing the contract, they would always charge more.

  The reporter recently contacted 58 rental housing contacts in the same city on the grounds that they needed to rent a house just after graduating from university. The other party claimed that it was not an intermediary but an agent. After taking the reporter to see the house, he said that the house can be "discounted", reminding the reporter that the original monthly rent of the house was 1920 yuan, but if it can be paid annually, the rent for 2 months can be exempted, which is equivalent to only 1600 yuan per month.

  According to industry insiders, this is one of the usual routines of black intermediaries. “In fact, some illegal intermediaries use various preferential conditions to defraud the owners of the house keys and a one-month vacancy period in the name of house rental agents. At the same time, the rent can be “discounted” without intermediary fees as a “bait” to attract renters. If the tenant fancy this house, the rent must be paid at least half a year or annually. This method can allow these Unscrupulous intermediaries accumulate large amounts of cash in a short period of time, and then look for opportunities to take the money and run away."

  The reporter visited and found that some second landlords "acted" to coax the tenants and quit the tenants on the grounds that the partitioned room was investigated and dealt with by relevant departments, so as to arrange for the next batch of tenants to move in again and repeatedly obtain benefits. According to industry insiders, this is called "washing" in the circle.

  "You can move in without a deposit" "Relieve the burden for graduates"... Some housing leasing companies advertised straightforward and attractive slogans. Many fresh graduates were attracted because of this, but they did not know the many "tricks" hidden in the contract. . A worker who has been engaged in the rental industry for many years said that in recent years, some rental intermediaries have colluded with online loan companies to use credit renting as bait to make tenants accidentally "be loaned online."

Unknown litigation subject makes it difficult to defend rights

  In recent years, the housing rental market has continued to be regulated. In December 2019, the Ministry of Housing and Urban-Rural Development and other six departments issued the "Opinions on Rectifying and Regulating the Order of the Housing Rental Market" to regulate the operation of the main players in the housing rental market and protect the legal rights and interests of all parties to the housing lease, especially the tenants.

  On December 30, 2019, the Guizhou Provincial Department of Housing and Urban-Rural Development and other six departments issued the "Ten Measures for Further Strengthening the Management of Real Estate Intermediaries in Guizhou Province", proposing 10 measures such as strengthening the supervision of financial services and strengthening industry self-regulation. Sichuan has also introduced measures to regulate the release of housing information by intermediary agencies, and implements demonstration texts of housing lease contracts and online signing.

  At present, renting a house is still the way of living chosen by many people, especially young people. On the one hand, there is a large demand for rental housing. On the other hand, capital rushing to the beach has caused serious housing monopoly, and the right to speak of the two parties is not equal. This has caused the chaos in the housing rental market to be difficult to eradicate.

Lower illegal costs increase the difficulty of cracking down on black intermediaries. Chen Jun believes that housing lease contract disputes and intermediary contract disputes caused by black intermediaries are often due to ambiguous contract loopholes, resulting in losses that cannot be fully compensated; there are also black intermediaries that directly lose contact or block tenants because of tenants. Failure to grasp the real information of the intermediary has led to the ambiguity of the subject of the litigation, and thus no way to protect rights.

  Guo Qiuxu, a policeman from the Yunyan Branch of the Guiyang Public Security Bureau, believes that some tenants lack legal awareness and cannot correctly identify whether the housing is formal, and often let black intermediaries take advantage of the loopholes.

Supervisors teach you to identify black intermediaries

  Recently, the Hefei Municipal Housing Security and Real Estate Administration issued a risk warning on the issue of graduates’ renting, stating that intermediaries that have not registered as market operators and have not registered with the real estate authority are likely to be black intermediaries; rents are too low or zero commissions It is often a "trap" set up by black intermediaries, so be vigilant.

  Industry insiders suggest that housing leasing companies should be standardized and the market access mechanism and "margin" system should be further improved.

  In addition, a corresponding credit certification system can also be established in the housing leasing industry, and mobile Internet technology can be used to conduct "real name + credit" dual certification for both parties in the transaction and leasing. For rent arrears, landlord and tenant breach of contract, and untrustworthy real estate transactions, it is linked to the social credit system. At the same time, it refers to the content of the credit report to further refine the power and responsibility standards.

  It is understood that a lease contract with complete clauses and clear content is an important evidence in the event of a lease dispute. In the case of renting disputes, whether it is a complaint to the market supervision department or the court, the lease contract is the first review element.
