The conditions in which the employees who take up teleworking definitively carry out their function must be negotiated and agreed with their companies, according to the latest advances in the conversations that the Ministry of Labor has with employers and unions to regulate this labor modality.

The application in each company will therefore depend on collective bargaining . The change supposes that Labor has significantly modulated its initial proposal of June 26. The conditions raised in that version of the preliminary draft that is being processed urgently unleashed alarm in business organizations due to the "rigidities" that it imposed when implementing remote work and that led the CEOE president, Antonio Garamendi , to warn that Excessively strict regulation could lead employers to consider hiring in other countries, such as Portugal.

As in many other initiatives of an economic nature, the opinion of the Minister of the Economy, Nadia Calviño, has asserted itself in avoiding what was considered a very untimely reason for labor unrest. In turn, it remains to be specified what regular and irregular work is to give legal certainty, as well as that the priority of telework is limited to those employees who want to voluntarily access it under equal conditions (in the preliminary draft, people with dependent or breastfeeding care).

The intention of the Government is to have the rule ready as soon as possible to count on the regulation of teleworking in the event that a situation similar to that of recent months occurs again.
