When renewing, the increase in rent is based on not exceeding 5% of the existing rent, but if the local government wants it, it is effective to allow the local government to set an upper limit within 5% through ordinances.

In the metropolitan area, such as Seoul, where the rent to cheonsei ratio is high, it is expected that the rent increase will be less than 5% considering the inflation rate.

This is a structure similar to limiting the price increase when renewing a contract for a private rental house with more than 100 households.

In the Private Lease Special Act, private lease housing with more than 100 households is set within 5% when raising the rent, and the city, county, and autonomous districts are obliged to comply with the stipulated ratio by ordinance.

In some cases, a method was proposed by the local government to set and announce the standard rental level, but it seems that the local government has found a compromise by allowing the local government to redefine the rent increase within 5%.

In addition, the contract gang application rights system was decided to apply to existing tenants whose contracts remain in existence prior to the enforcement of the law.


There is a controversy over the retroactive legislation, but the party has no precedent in the case of the previous revision of the Commercial Lease Protection Act, so there is no major problem.

The monthly rent limit is applied only when renewing an existing contract, and there is a limit that the landlord can raise the rent that has not been raised at the same time when the existing contract ends and receives a new tenant.

To prevent this, Lee's bill was to set a rent increase rate based on the rent of the existing contract when a new tenant was received less than a year after the existing contract ended.

However, considering that the legislation lacked time to discuss the bill, the government decided to first enforce the Lease 3 Act and discuss it again if such side effects are observed in the future.

The party will also introduce a contract gang application right system, while also clearly defining the conditions under which tenants can refuse to renew contracts to protect the landlord's rights and interests.

If the landlord needs to go directly to the house where the rent was rented and prove it in a situation where he/she needs to live, he will stipulate the conditions to exclude the right to apply for a contract renewal, such as allowing the request to renew the contract.

The government plans to pass the three-legal lease bill at the plenary session of the National Assembly scheduled for next month.
