The Rental Dispute Resolution Center, the judicial arm of the Dubai Land Department, has issued a ruling to annul the rental relationship due to the implications of the effects of the Corona virus, which had a direct impact on the nature of the tenant's work.

The court ruled, in the ruling, which the Emirates Today viewed, that the lessor will return the remaining checks from the lease term while refunding the amount of the rental insurance.

The decision to terminate the rental contract came in accordance with Article 794 of the Civil Transactions Law for the existence of an emergency excuse, as the paragraph states in paragraph (1) that one of the contractors for an emergency excuse related to it may request the termination of the lease contract.

The Center sets conditions for the dissolution of the rental relationship between the lessor and the lessee, which falls within the effects of the Corona pandemic, the most prominent of which is the suspension of commercial activity in a way that decreases revenues by rates ranging between 60% to 70%, and this is in the case of commercial leases.

Regarding the details of the case, the court said in its operative ruling that "the tenant submitted an application for the annulment of the rental contract requesting a refund of the rental value, due to urgent circumstances that affected her, preventing her ability to continue her work in the implementation of the contract and that is stopping her from practicing her activity completely for an unknown period as a result of The repercussions of the Covid virus 19.

The Center for Conflict Resolution in Wasil last month had taken several measures since it related to rental issues that were affected by the consequences of the Corona virus, including the establishment of three judicial committees that specialize in such cases, two primary and one appeals headed by the head of the center.

The Center pointed out in previous statements that the mission of these committees is to consider issues in which the dispute is linked to the implications of the Corona virus, on one of the parties to the rental relationship or both, and aims to expedite the resolution of such disputes, which are linked to urgent rental and housing issues.

The Center pointed out that provisions will be related to issues that are verified by the papers that the dispute arising between the parties has the effects of this sanitary condition, in accordance with the laws and legislation in force in the Emirates.
