The Center for Lease Dispute Resolution, the judicial arm of the Dubai Land Department, issued a ruling ordering the dissolution of a rental relationship for a tenant whose nature of work has been affected by the consequences of the Corona virus.

The Center ruled, in the ruling that the Emirates Today viewed, that the lessor returns to the tenant the remaining checks from the term of the lease, in addition to refunding the insurance amount.

The lawsuit papers indicated that the ruling on “resolving disputes” relates to a center for the care of the elderly and children, and that the annulment came based on the documents provided by the tenant to demonstrate their actual damage from the “Corona” crisis.

The papers presented in e-mails issued by several clients indicated that they canceled their contracts for fear of spreading the infection in light of the spread of the new Corona virus, as the groups who were caring for them at the center are considered to be most vulnerable to complications from the virus.

The ruling to annul the lease contract came on the basis of the Civil Transactions Law due to the existence of an emergency excuse, as the first paragraph of it stipulates that one of the contractors for an excuse related to it may request the termination of the lease.

The center stated in its ruling that “the tenant has applied for the annulment of the rental contract requesting that the rental value be recovered, due to emergency circumstances that affected her, which prevent her ability to continue her work in the implementation of the contract, which is represented in her stopping her activities completely and for an unknown period due to the consequences of a virus (Coved-19) ».

It is noteworthy that the Center for Settlement of Tenancy Disputes sets conditions for the dissolution of the rental relationship, regarding the state of commercial rents, which fall within the pandemic effects of "Corona", the most prominent of which is the suspension of commercial activity in a way that decreases revenues by rates ranging between 60% and 70%.
