If the fight against waste is a constant fight, certain foodstuffs, because of their health risk, cannot be the subject of donations. This is the case, for example, with meat. A recent decree in effect prohibits donations of animal products, but nevertheless raises some exceptions.

Exceptional conditions

Published in the Official Journal of May 23, this text prohibits donations of food of animal origin, given the health risk linked to their conservation. However, to avoid throwing away and wasting products that are still consumable, the decree lays down conditions derogating from this rule.

Direct delivery establishments (i.e., the commercial catering and distribution and food service industries), as well as wholesalers, are allowed to donate these products if they are prepackaged .
Donations are still possible for approved agrifood operators, if the animal foodstuffs are intended for a food aid actor and provided that the products bear the European health or identification mark.

Finally, collective catering is affected by these exceptions since here, donations of prepackaged products and culinary preparations prepared in advance and not presented to customers are legalized.
