The second extension of the ERTE comes into force next Wednesday and proposes an increasingly restrictive aid system until September. Starting next week, the labor framework tries to bring all the productive tissue back to normal, which has left the coronavirus pandemic. The objective is that this transit be done with the lowest possible cost in the disappearance of companies and jobs.

What protection scheme will companies and workers have from next week? In the absence of the Government publishing the details of the agreement agreed with the social partners next Saturday, companies that abandon ERTEs of force majeure will be able to avail themselves of regulatory dossiers temporary employment for ordinary economic and operational causes (ETOP) but with benefits in contributions. What are these benefits? For companies with less than 50 workers who are now subject to ERTEs of partial force majeure (with part of their staff reincorporated to their post) and ETOPs, exemptions reach 60% for active workers and 35% for those who remain in the ERTE, while for those with more than 50 workers they will be 40% for each worker reactivated since suspension and 25% for the one that followed in the ERTE. Is there a possibility of returning to the scheme of total force majeure? Yes. In the cases of companies and workers that due to the situation of their business cannot be reactivated or that there is a re-emergence of the disease that forces restricting mobility or confinement, will it be enough? Employers have pressed throughout of the last weeks to obtain the greatest possible discounts from Social Security, which is the one who collects contributions, but the Government is concerned about the high cost that the State is paying to support the productive fabric. In April, at the most serious point of the crisis, 570,000 companies with more than 3.4 million workers accepted the schemes. In total, aid for all kinds of reasons was extended to more than 8 million people.

Will the accountant remain at zero of the right to collect benefits? Yes. UGT and CCOO have guaranteed that in the next three months the workers who are charged for being included in an ERTE related to the situation created by the coronavirus can maintain the collection of unemployment benefits without losing the right to subsequent payment if they are finally dismissed. Are those benefits taxed? Yes. The State Public Employment Service does not withhold payments so that when workers affected by an ERTE make their personal income tax declaration in 2021, they must declare such aid and, according to calculations by the Council of Economists, they must pay unless their wages be mileuristas. The recommendation of the Council of Economists is that companies apply the corresponding deductions in payrolls when they reinstate their workers. Will companies be able to hire more staff while they are under ERTE? No. The agreement prohibits companies from hiring before reactivating their workers in ERTE, as well as from overtime work, the establishment or resumption of outsourcing of the activity, and the conclusion of new contracts, either directly or through from a temporary agency.
