His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister, in his capacity as Ruler of Dubai, issued Law No. (2) of 2020 amending some provisions of Law No. (2) of 2016 establishing the Dubai Data Corporation, by replacing the provisions of Articles (2) , (7), (9), (10), (11), (12) and (14) of the original law, to be replaced by new texts related to the powers of the Director General of Dubai Smart Department, the executive body of Dubai Data Corporation, and the powers of its CEO , Financial resources and their budget, in addition to the powers to issue executive decisions related to the implementation of this law.
The amended Article No. (7) included the powers of the Director General of Dubai Smart Department, including: overseeing the work of the Dubai Data Corporation, ensuring that it fulfills its terms of reference, adopting the Corporation’s general policy, strategic and operational plans, overseeing its implementation, as well as approving the organizational structure and annual project of the Foundation, and approving The projects, programs and initiatives of the institution, and the adoption of the necessary legislation to enable it to achieve its goals, and to submit it to the competent authorities in accordance with the procedures adopted in this regard, as well as other powers contained in the article in detail.
The executive
Article (9) of the law stipulates that Dubai Data Corporation has an executive body, consisting of the executive director, and a number of administrative, financial and technical staff, and the executive body of the institution is entrusted with the task of carrying out its operational work, and following up on the implementation of decisions issued by the Director General of Dubai Smart Department, Provided that the Corporation’s Human Resources Management Law No. (8) of 2018, or any other legislation that replaces it, is applied to the Corporation’s employees.
Article (10) of the new law stipulates that the Executive Director of Dubai Data Corporation be appointed by a decision of the President of the Dubai Executive Council, and the Executive Director is responsible to the Director General of Dubai Smart Department for the implementation of the tasks entrusted to him under this law and the decisions issued pursuant thereto, and the CEO The Corporation has a number of tasks and powers that are covered in detail in the Article, and Article (11) of the law defines the financial resources of Dubai Data Corporation.
Necessary decisions
With the exception of the decisions that the general manager of Dubai Smart Department is competent to issue in accordance with the provisions of this law, the President of the Executive Council of the Emirate of Dubai shall issue the necessary decisions to implement the provisions of this law, and Article No. (8) of Law No. (2) of 2016, which was related to the powers of the Chairman of the Board of Directors Also, any text in any other legislation shall be canceled to the extent that it contradicts the provisions of this law, and it shall be implemented by Law No. (2) for the year 2020 from the date of its issuance, and published in the Official Gazette.
