The Rental Dispute Resolution Center, the judicial arm of the Dubai Land Department, stated that the landlord is obligated to pay the joint ownership fees unless the lease agreement stipulates otherwise.

The head of the Center for Lease Dispute Resolution, Judge Abdel-Qader Moussa, said that Article No. (16) Paragraph (B) of Law No. (6) of 2019, regarding joint ownership, which was recently issued, stipulates that it is the responsibility of the landlord to pay the service allowance and allowance Usage, unless the unit's lease agreement stipulates otherwise, and in all cases the owner is not exempt from paying the service allowance and use allowance in the event that the tenant fails to pay them in the manner prescribed by this law, and Article (B) of the same article states that the owner The tenant is obligated to abide by the statute, the basic assembler system, and the building management system , And they are bound to the rest of the owners and occupants of other units, and before the angel before the point of administration. Judge Moussa explained that, according to the provisions of the law, the owner is obligated to pay fees for service and usage allowances for the joint ownership areas, unless otherwise specified in the lease contract, noting that the common areas include all the common parts of the property, and the fees include cooling bills for these areas or the so-called By "District Cooling" or "District Cooling."

He stressed that the bills approved by the Real Estate Regulatory Agency (RIRA) are the reference in the event of disputes over the fees of these areas, and that failure to pay these fees could cause the owner to sign problems that he is indispensable as the original responsible for these fees, and that the accumulation of these Fees can cause the housing unit to be sold for the benefit of paying these fees.

In addition, Judge Moussa said that the disputes of the joint areas in the past were within the jurisdiction of the Dubai courts, and they moved according to the new law to the center, pointing out that most of these disputes were related to the dispute over the value of fees, and the complaint that owners did not benefit from some services.

He added that the center will work on the latest smart systems in relation to these disputes, thus ensuring access to rapid solutions related to joint ownership disputes.
