The Dubai-based Center for Litigation Disputes (LCRC) has unveiled a lease dispute worth more than AED 148 million between two large companies, one in the real estate development sector and the other in trade.
The Center told Emirates Today that disputes between the two parties reached 12 cases, between the dissolution of a contract, financial settlements and compensation, but it was able to bring the two sides closer, which culminated in a friendly solution in the end.
Friendly solution
In detail, the head of the Dubai Land Litigation Center, Judge Abdul Qader Moussa, said that a lease dispute took place between two parties in Dubai, one of them a real estate development company, while the other is a commercial company that owns a series of retail stores. To the Center to resolve the dispute between them, where the value of claims amounted to 148 million and 281 thousand dirhams.
Moussa, in special statements to «Emirates Today», that the judges of the Center were able to bring the two parties closer, where they finally reached a friendly solution between the two companies, which maintained their commercial relationship.
Moussa pointed out that the decree establishing the center provides for resorting to consensual solutions at the beginning, where the judges of the center work to bring the views of the conflicting parties before the initiation of litigation, pointing out that most of the center's judges hold certificates in the art of negotiation, in addition to ongoing training courses held by Center with the official authorities in this aspect.
Breach
Mohammed al-Kaabi, the primary judge at the Center for Litigation Dispute Resolution, explained that the recent dispute occurred between two of the largest companies operating in Dubai, where the commercial company resorted to the center to cancel the lease contracts with a subsidiary of the property developer, claiming a breach by the developer In return, the commercial company seeks financial compensation for its withdrawal from the lease before the end of its contracted period.
Al-Kaabi added that the dispute included a set of cases filed between the two parties, amounting to 12 cases between a financial claim and compensation, and another requesting the cancellation of lease contracts, pointing out that he sought the parties' desire for a friendly solution, which made him work to bring the two sides closer.
Success
Al-Kaabi said that specialized experts were assigned to identify the problem and its causes and ways to solve it, which was successful in the end, as a friendly solution was reached after six negotiating sessions between the two parties.
Al-Kaabi pointed out that the Center, in cooperation with the two disputing parties, reached a solution by paying the commercial real estate developer and its subsidiary the amount of 37 million dirhams, to be waived all the cases filed by the parties, pointing out that one of the most important fruits of this agreement, to maintain the relationship Trade between the two parties, which extends to other projects, is not subject to dispute.
