Dubai's Land Litigation Center, the judicial arm of the Dubai Land Department, said it had halted the eviction of 30 sub-rented families.

The center told Emirates Today that the owner of one of the buildings was able, through the submission of preliminary documents, to obtain a decision to evacuate the original tenant for not paying the rent for a long period of time, but the center stopped the judgment after it was found that the families in the building.

The Center pointed out that the lease law stipulated that a written consent from the landlord is required in case the original tenant wishes to sublease.

Fahad Ahmed Bin Khadim, the Center for Urgent and Temporary Matters, disclosed that the Center has suspended the eviction order against sub-tenants in one of the buildings, after the owner of the building was able to obtain the eviction of the original tenant.

Benkhadem explained that the landlord was based on obtaining the ruling that the tenant did not pay the rent for a long period of time. The Center was forced to suspend execution to clarify the matter, as it was found that the original tenant had written consent from the landlord to lease, and that his rental of families did not have bad faith on his part.

Judge Abdulkader Moussa, head of the Dubai Center for Leasing Disputes, confirmed that sub-leasing may only be done with the written consent of the landlord, noting that the law allowed the landlord, in the absence of written consent, to file an eviction claim against the original tenant.

If the tenant leases the subcontractor or any part of the property without obtaining such consent, the landlord has the right to evacuate, he said, adding that in this case the eviction applies to the original tenant and the sublease, with the latter retaining the right to refer to the tenant. He advised tenants and landlords to familiarize themselves with Dubai's rent law in order to avoid future rent disputes, pointing out that the quality and competitiveness of the emirate's rental sector in the world requires working on the principle of awareness to maintain this competitiveness.
