U.S. ITC reviewed decision to lose SK Innovation early

The US International Trade Commission ITC has accepted a request to review the battery lawsuit filed by SK Innovation. ITC said LG Chem is reviewing SK Innovation's early decision to lose in the lawsuit against SK Innovation.

Earlier, on February 14th, ITC made an early decision to lose by saying that SK Innovation's alleged destruction of evidence is clear.

Accordingly, SK Innovation asked ITC to review the preliminary decision on the 3rd of last month.

However, experts do not expect the results to be overturned.

ITC review As a normal procedure, from 2010 to 2018, all the preliminary decisions reviewed by the litigation parties were conducted, but the results of the preliminary decision were rarely reversed.

ITC will make a final decision in early October to decide whether to violate US Customs Act 337, remedy, and deposits.

Depending on the final decision, SK Innovation's battery-related parts and equipment may be subject to import bans.

Therefore, the industry believes that LG Chem and SK Innovation will conclude the case with an agreement after negotiating financial compensation regardless of the rest of the lawsuits.

In April of last year, LG Chem filed a lawsuit against ITC that SK Innovation violated its battery-related business secrets, and in November of last year, asked for an early decision to lose due to the destruction of evidence by SK Innovation.

LG Chemical also sued the Federal District Court in Delaware, USA in April of last year for infringement of trade secrets, and in May, sued the Seoul Metropolitan Police Agency on charges of leaking industrial technology.

In response, SK Innovation responded in June last year with a lawsuit against LG Chem for damages due to defamation, and filed a patent infringement lawsuit in September in the US ITC and Delaware courts.

Accordingly, LG Chem again filed a lawsuit against patent infringement, and ITC is also in the process of patent infringement, and the Delaware State Court is currently suspended.
