A homeless man who murdered after assaulting a benefactor who had done him favor for four years was sentenced to a heavy sentence in the Supreme Court.

Today (23rd), the third division of the Supreme Court (Presidential Judge Noh Tae-ak) announced that it has confirmed a court case sentenced to 18 years in prison in the appeal of Mr. A, who was accused of murder.

Victim B, a poor street vendor selling flowers and potted plants in the market, has been showing warmth to those who do not have a place to live like A, despite the lack of conditions.

It is known that Mr. A has been given an allowance of 10,000 won every day since the winter of 2015, and has provided a rooftop room in the building he manages as a residence.

However, Mr. A disliked Mr. B's favor of other homeless people.

Moreover, when Mr. B rejected his request to "pass over the building management work," he even became resentful.

Meanwhile, another homeless, Mr. C, lied to Mr. A in September of last year, saying, "Mr. B says he doesn't want to see you again," and angry at this, Mr. A visited Mr. B and committed the crime.

The investigation revealed that Mr. A killed Mr. B by striking him and strangling him with an electric wire.

Even after Mr. B's death, he showed cruelty by damaging his body with a weapon, and he stayed at the scene for 3-4 hours to cover up the evidence.

The first trial court sentenced Mr. A to a 15-year prison sentence for his crime as a'normally motivated murder'.

The court's sentencing criterion for murder crimes is divided according to the motive of the crime, and the common synchronous murder, which includes the case of ``killing with resentment because he thought he was humanly neglected or despised by the victim,'' is subject to a sentence of 10 to 16 years in prison. .

However, the court of appeals court raised the sentence to 18 years in prison, saying, "Mr. A's crime is not a common synchronous murder, but a'critical-motivated murder', especially'random murder with no other reason'."

It is difficult to accept that Mr. A felt that Mr. B was humanly neglected by Mr. B, who did good deeds to him.

If condemned as a condemned homicide, you may be sentenced to 15 to 20 years in prison, which is heavier than a normal synchronous murder.

The judge said, "Mr. A trampled on Mr. B's life because he was dissatisfied with his refusal to forcibly refused the request even though he received help from Mr. B. The unfair result of the victim ending his life without knowing the English The result is a greater responsibility than in the case of normal synchronous murder.”

Mr. A appealed that the sentence was unfair, but the Supreme Court confirmed the sentence as the judgment on the appeal was justified.
