The Apple brand - Geeko

The Prepear app and its pear logo are in Apple's sights. The Californian giant sees too much similarity between the fruit used in the visual identity of the culinary portal and its famous apple. The company has turned to justice and formally opposed the registration of Prepear's logo on March 25, reports The Verge . Apple believes that this "generates a dilution of the singularity" of its own logo.

In its complaint, Apple claims that the pear in the kitchen app “immediately recalls the famous Apple logo”. The Cupertino (US) company claims that “Apple's symbols are so famous and instantly recognizable that the similarities of [Prepear's] symbol will erase every difference and cause ordinary consumers to think [Prepear] is. linked, supported or owned by Apple ”.

The complainant also notes that the two companies offer "identical or very similar goods and services" and that Prepear is active "in the natural expansion zone" of Apple's activities. The reactions were not long in coming from those responsible for the app. On Instagram, co-founder Natalie Monson indicated that her company "was defending itself […] not only to keep its logo but also to send the high-tech giants the message that harassing small structures is not without consequences".

Dear Instagram Friends- I NEED YOUR HELP! I know there are a lot of heavy things going on in the world right now, and this is nothing in comparison, but I need your help in a situation that is affecting me, my family, and my coworkers. Please help! Many of you know that I started a business called Prepear almost 5 years ago. It is an app that you can store all your recipes in one place, plan your meals, make grocery lists, and get your groceries delivered all in one place. Recently @apple yes, The trillion dollar Apple, has decided to oppose and go after our small business' trademark saying our pear logo is too close to their apple logo and supposedly hurts their brand? This is a big blow to us at Prepear. To fight this it will cost tens of thousands of dollars. The CRAZY thing is that Apple has done this to dozens of other other small business fruit logo companies, and many have chosen to abandon their logo, or close doors. While the rest of the world is going out of their way to help small businesses during this pandemic, Apple has chosen to go after our small business. I'm not trying to get anyone to stop using or buying Apple products. I feel a moral obligation to take a stand against Apple's aggressive legal action against small businesses and fight for the right to keep our logo. We are defending ourselves against Apple not only to keep our logo, but to send a message to big tech companies that bullying small businesses has consequences. "Apple has done the same thing to dozens of other small businesses whose logo was a fruit and many have gone out of business or chosen to change their logo," denounces the entrepreneur. Russell Monson, another co-founder of Prepear, has started an online petition calling for “an end to Apple's aggressive opposition to companies with fruit logos”. The latter had gathered more than 28,000 signatures on Monday.
