The Supreme Court has announced its first official position while the National Assembly is discussing ways to create a separate court to be dedicated to the Justice Farmers' case. The Special Tribunal is unconstitutional because it has no basis in the Constitution and is likely to violate the independence of the judiciary. He also argued that the system of the court can now be fair enough.

First, I will tell from the official position of the Supreme Court.

In June, a prosecution investigation into the suspicion of judicial farmers of the Justice Department of Yung Sung Tae began.

However, when the court dismissed the search warrant for nearly 90 percent of cases without precedent, it became a criticism that my ward was being wrapped.

I was worried that I would not be able to see it in the trial of judicial farmers.

So, in August, 56 Democratic Party lawmakers Park Chung Min and others proposed the introduction of a special court to take charge of the case, and the four opposition parties agreed to introduce a special court law last month.

The Democratic Party plans to appoint three members of the Chief Justice of the Supreme Court, when nine nominees nominated by the Chief Justice of the Supreme Court nominate six candidates for special judges.

The Supreme Court issued a 10-page statement to the National Assembly that made it clear that the Special Tribunal had no basis in the Constitution.

First, it argued that it is unconstitutional to intervene in the process of establishing a special court judge, such as the National Assembly and the Korean Bar Association, and that it may be viewed as a violation of the independence of the judiciary.

The method of selecting the right person from the beginning and entrusting the trial was said to be able to invite fairness rather.

I hear that even if a special court is enforced, the judge will be suspended for a while if the defendants are asked to judge the Constitutional Court as unconstitutional.

The Supreme Court has argued that the current court system, like re-allocating the court in the event of fairness, can solve the problem.
