The Supreme Court has established that it is a crime to put a sticker from the Technical Vehicle Inspection (ITV) on a car when it has not been overcome, thus confirming the fine of 720 euros imposed on a tourist owner who had it affixed to the Front moon an ITV sticker with a validity date of September 2019, when the vehicle had expired the inspection since May 2016.

In its sentence, the Supreme Court has indicated that the accused "for a false purpose and with the objective of not being penalized for having the ITV expired" used an authentic document without being its legitimate owner. The convict appealed defending the atypicality of his conduct, considering that the improperly affixed sticker was neither an official document nor a certification that justified that penalty.

However, the ruling of the high court resolves that it can be considered an official document or certification for the purposes of the crimes of falsehood described in articles 390 and following of the Penal Code, so that the use of a genuine distinctive but in a vehicle that did not pass the review can integrate the crime of article 400 bis of said Code.

Although it is not an identical case to the court now, two years ago the Local Police of Santa Cruz de Tenerife disclosed one of the grossest episodes of forgery of the ITV sticker. She posted it on her tweet.
