Atletico Madrid's Hispanic-Brazilian striker, Diego Costa , has pleaded guilty before the Madrid Provincial Court to a tax offense amounting to 1.1 million euros . The player sat this morning on the bench of the accused after reaching an agreement in accordance with the Prosecutor's Office and has admitted the facts imputed to him by the Tax Agency in his complaint, which was revealed by EL MUNDO.

In this way, the judicial process concludes with a six-month prison sentence , which does not imply compliance and that the footballer has also agreed to be replaced by a 12-month fine at a rate of € 100 per day, for a total of € 36,000. . The State Bar has been against this point of the agreement, as it has done in other soccer cases. It should be remembered that Costa already reimbursed the Treasury a few months ago the amount of 1,142,888 euros that he evaded during the 2014 financial year.

As this newspaper advanced, the Tax Agency denounced Costa for defrauding taxes during the season in which he left Atlético de Madrid to sign for London Chelsea . The Spanish Treasury has considered that it did not correctly pay the advertising contract that it signed with Adidas for an amount of 800,000 euros. As has happened with other soccer players reported by the Treasury, Costa did not pay the corresponding taxes in Spain after changing his residence.

In the case of Costa, according to the Treasury, the issue is that during 2014 he lived for six months in Spain and, nevertheless, was taxed during that year as a tax resident in England. For his part, the footballer defended his inspection as a British taxpayer during that year. It is, therefore, a very strict interpretation of the regulations by the Tax Agency, which has closed other similar files through administrative channels. Not surprisingly, in the case of Costa it is a mere discussion about his tax residence but there is no evidence that he has used 'off shore' companies and figureheads to hide his image rights.

Initially, the Treasury attributed to the athletic player another tax offense, this time corresponding to the 2013 financial year, and raised the fraud committed to 2,306,000 euros. However, the Treasury accepted the allegations presented by its advisers, headed by the lawyer Carlos Sáiz, from Gómez Acebo & Pombo, assisted by the Portuguese lawyer Ricardo Cardoso, withdrew one of the crimes against the Public Treasury and halved the defrauded fee .

After refusing to reach an agreement with the Treasury, the footballer reconsidered his position and decided to reach a pact, as have the vast majority of footballers involved in recent years in similar cases. Costa reimbursed the defrauded quota to the Treasury through a bank transfer made on August 8. Then, he asked Atlético de Madrid to take over the payment of his fiscal problems. The club, which did not want to pay the player's fine, nevertheless made an advance of his payroll so that he could pay the Treasury without problems.
