The Fifth Section of the Provincial Court of Valencia has sentenced a man who sexually forced his sister

to 15 years in prison for a continued crime of sexual assault on a minor when she was 12 years old.

The sentence imposes the payment of compensation of

30,000 euros to the minor

for moral damages.

In addition, the convicted person will not be able to get closer than 300 meters or communicate with her by any means for 16 years. Likewise, he will not be able to engage in any profession that involves regular and direct contact with minors for 20 years.

The defendant and the victim,

brothers on their mother's side

, had an excellent relationship, according to the account of proven facts included in the sentence. The girl lived with their mother in a municipality in the Requena-Utiel region, and the

accused, 24 years old

at the time of the events, frequently went to the family home to sleep there regularly.

The Court has declared it proven that on July 11, 2021, when both brothers were sitting on the sofa in the house, the first of the attacks occurred. The now convicted man then grabbed the girl by her neck and told her to do what he told her about her or "he was going to kill her, he would drive her car over her," to then force her to have sexual relations.

Two days later, he entered the minor's bedroom at dawn, when the rest of the family members were sleeping, and after staring at her and saying "sorry, but I'm going to do it again," he repeated the attack. Subsequently, she moved her to the kitchen gallery and raped her again, asking her "forgiveness" when he finished.

The victim suffers symptoms of post-traumatic stress

as a result of the events, has tried to harm herself and has feelings of helplessness and distrust because the aggressor is her brother, with whom she had a strong attachment. The sentence is not final and can be appealed before the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
