The Minister of Education and Vocational Training, Isabel Celaá, has once again allowed this academic year to pass a course without limit of failures, as she did the previous one.

It does so in a royal decree that has been approved this Tuesday in the

Council of Ministers

and that contradicts a higher-ranking law, the Lomce, which is still in force.

The Ministry has advanced in a statement that in this royal decree, which contemplates extraordinary educational programs aimed at enabling the development of the

2020-2021 academic

year

, "the evaluation, promotion and qualification criteria are adapted" in

Primary

,

Secondary

and

Baccalaureate

so that

students

Autonomous governments "may authorize their modification to better adapt them to the situation caused by the pandemic."

This means, in practice, that "the teaching teams will assess collectively and globally whether the objectives of each stage have been achieved".

That is to say, it will be the teachers who will decide in each case with how many failed subjects they allow each student to pass the course.

This provision clashes with what is established in the

2013

Wert law

, which clearly says that in ESO you cannot pass a course with more than three failures and in Baccalaureate with more than two failed subjects.

The Government and the Autonomous Communities agreed on this measure last April in order to complete in the best possible way a course marked by the suspension of face-to-face classes throughout Spain.

The change was highly questioned by the teachers' unions and the inspectors, who denounced that something contemplated in an organic law could not be changed by royal decree and considered it "illegal."

The PP went to the National Court, which admitted the appeal but rejected the very precautionary measure to request the stoppage of the measure.

The teachers themselves denounced that they had suffered pressure to approve students and the consequence of this wide sleeve of Celaá was translated into an increase in good grades in the Baccalaureate that practically touched the general approved in many autonomies.

The measure also allowed many differences by autonomy and a real territorial raffle: it was possible to obtain the Baccalaureate degree with failures in

Aragon

while in

Madrid it

was required to have all the subjects passed.

Now face-to-face classes have been resumed, but the minister once again adopts this controversial measure.

The decree contemplates more changes:

The minimum contents cease to be of the State

"In order to facilitate the adaptation of the didactic programs to the decisions that are adopted about the presence of the students in the centers, the character of the assessable learning standards is given as guidance," says the royal decree.

The Government allows to reduce the load of the curricula so that the students do not have to study so many things.

The assessable learning standards were determined, until now, by the

Ministry of Education

, and they were the contents that all students in Spain had to study because they were the ones who entered the exam.

They were important because they gave a certain uniformity to the system: they were minimums that were taught in all territories.

The measure implies that they are no longer mandatory and become "indicative";

that is, volunteers.

It is not clear whether each center decides what its students have to learn or whether it is the autonomous communities.

The measure, in any case, will generate differences in level by territories and a drop in level, because less content will be learned than in other years.

NO DIAGNOSTIC EVALUATIONS

For another year, the Government abolishes the end-of-stage Primary and ESO evaluations.

These tests are useful because they serve to diagnose what knowledge the students, the centers and the autonomies have.

They have no academic effects.

Removing them creates a statistical gap in the system because there are no other similar national tests.

PIRLS

DAYS WITHOUT PRESENTIAL CLASS ARE LECTIVE

"Regarding the school calendar, school days will be considered all those in which attention and educational support are given to students, either in person or remotely," says the decree.

This measure will generate problems when students have to quarantine themselves and are not given telematics class.

Celaá has said that it is mandatory to continue teaching the lesson to confined students, but in practice it is not being done.

TEACHERS WITHOUT MASTERS

The royal decree will allow, "exceptionally and temporarily", the

hiring teachers who meet all the requirements but who have not yet completed the specific master's degree or the pedagogical aptitude course (the old CAP).

This measure arises because there are not enough teachers in some branches of Secondary, Vocational Training, Music, Performing Arts, Plastic Arts and Design and Official Language Schools.

The teachers' unions, inspectors, rectors and deans are totally opposed because they say it will worsen the quality of teaching and accuse the government of "lack of foresight."
