According to people close to the judicial system, Chen Jun, who served as the political commissar of the Sichuan Women's Institute during Zhu Huaizhong's term as the director of the Sichuan Provincial Women's Institute, is also under investigation by relevant departments.

The two have worked in the same firm for many years

  Public resumes show that Zhao Zeyong and Zhu Huaizhong both worked in the former Xinhua Labor Camp in Sichuan Province in Mianyang, Sichuan.

From 1982 to March 2008, Zhao Zeyong served as a police officer, deputy squadron leader, and deputy director of the Xinhua Forced Labor Camp. In 2008, he was transferred to serve as the director of the Dayan Labor Camp.

Zhu Huaizhong started working in Xinhua Forced Labor Camp in 1993, and successively served as deputy secretary of the Youth League Committee, deputy director of the office, team leader, assistant to the director, and deputy director.

  From June 2001 to March 2008, Zhao Zeyong served as a member of the party committee and deputy director of the Xinhua Forced Labor Camp. During this period, Zhu Huaizhong served as an assistant to the director of the labor camp from 2004 to 2007.

From 2007 to 2008, the two were both deputy directors of the institute.

  Both the Sichuan Drug Rehabilitation Administration and the Women's Institute are subordinate units of the Sichuan Provincial Department of Justice.

On September 25, a person close to the Sichuan judicial system told The Paper that Zhao and Zhu may have been involved in the "past events" of the Xinhua Forced Labor Camp.

Since 2014, Zhao Zeyong has been a member of the Party Committee, Deputy Director, Police Supervisor, Level 2 and Investigator of the Sichuan Drug Rehabilitation Administration; Zhu Huaizhong was transferred to the Sichuan Provincial Women’s Compulsory Isolation Drug Rehabilitation Center in 2011 as Party Secretary, Director, and Investigator , Second-level senior sheriff.

The institute is located in Deyang City, Sichuan Province.

After the two left the Xinhua Forced Labor Camp, they had no direct work interaction.

However, a person familiar with the matter believes that Zhao Zeyong and Zhu Huaizhong should be mainly involved in the loss of state-owned assets of the Sichuan Women's Institute, which is hardly a secret within the judicial system.

State-owned assets provide loan guarantees for private enterprises

  The Paper found several judgment documents related to the Sichuan Women’s Office on the China Judgment Documents website. In 2012, Ye Sijie, Luo Changhua and the original Sichuan Zhongzheng Xinyuan Trading Co., Ltd. were in urgent need of capital turnover due to real estate development. People borrow 15 million.

The Sichuan Women’s Institute-Sichuan Xingnan Craft Products Factory and Sichuan Xingnan Trading Co., Ltd. voluntarily used commercial supplies with a construction area of ​​2,997.78 square meters in the southern section of Taihe Avenue, Shehong County, and an estimated price of RMB 13,463,010. The house is used as a mortgage guarantee.

  The Paper noted that the original legal representative of Sichuan Xingnan Craft Products Factory was Zhu Huaizhong, the then female director, and the legal representative of Sichuan Xingnan Trading Co., Ltd. was Huang Jia, who was also the police officer of the institute.

  According to the judgment, on December 14, 2012, Zhu Yuanlin, Ye Sijie, and Luo Changhua, accompanied by the Sichuan Women’s Institute political commissar Chen Jun and two corporate asset managers, conducted an on-site inspection of the secured real estate, and the three parties reached an oral mortgage guarantee agreement.

Since the commercial house used by the female firm for mortgage guarantee only has a real estate certificate, and there is no land use certificate, it is impossible to apply for mortgage registration at the Housing Management Bureau.

  On January 15, 2013, the borrowing parties formally signed the 15 million "Loan Contract", and the loan is for construction.

However, after the agreed repayment time expired, the borrower did not repay the arrears in time, and the two parties signed the "Loan Extension Agreement", but the loan was not repaid after the extension expired.

  On November 11, 2013, Zhu Yuanlin made a written collection to the borrower and the guarantor.

Both Zhu Huaizhong and Huang Jia signed and sealed it.

  Since Sichuan Women's Office also needed to borrow from the bank later, it negotiated with Zhu Yuanlin to take back the title certificate and use it to apply for a mortgage loan from the bank.

As a consideration, two companies under the Sichuan Women’s Institute that participated in the guarantee issued a "Letter of Commitment" to Zhu Yuanlin. The letter of commitment stated that due to the loan needs of the Sichuan Women’s Labor Camp, they will mortgage Zhu Yuanlin’s real estate with a total of 13 Ability back.

At the same time, he promised that the amount of mortgage loans from the bank would be limited to 15 million yuan and be mortgaged to Zhu Yuanlin in turn.

The guarantee period is three years.

  However, as of September 29, 2014, the borrower had still not paid off the loan, and still owed the principal amount of RMB 115,480,070, and the interest of RMB 996,744.

In 2017, Zhu Yuanlin sued the borrower and the affiliated enterprises of the Sichuan Women's Office together.

  On January 23, 2019, the People's Court of Zizhong County of Sichuan Province ruled that Ye Sijie, Luo Changhua, Sichuan Xinghehui Trading Co., Ltd. (formerly Sichuan Zhongzheng Xinyuan Trading Co., Ltd.) shall repay Zhu Yuanlin's loan principal of RMB 11,584,107 and interest of RMB 996,744 within 10 days; Sichuan Xingnan Trading Co., Ltd. and Sichuan Xingnan Craft Products Factory, which are subsidiaries of Sichuan Women's Institute, bear joint and several liability for the settlement.

  Two companies under the Sichuan Women's Institute refused to accept the judgment and appealed to the Intermediate People's Court of Neijiang City, which was rejected and the original judgment was upheld.

Incomprehensible guarantee reason

  The Paper noted that when the case was accepted and filed by the Zizhong People's Court on April 24, 2017, Zhu Huaizhong was still the director of the Sichuan Women's Institute and the legal representative and factory director of the Sichuan Xingnan Craft Products Factory.

  During the litigation of the case, the reasons for the defense of the guarantee provided by the two companies affiliated to the Sichuan Women's Office were difficult to understand.

  The two companies argued that the guarantee had not been approved by the superior authority and therefore the guarantee was invalid.

At the same time, the borrowers, Zhu Yuanlin and Ye Sijie, colluded or fraudulently obtained guarantees from the two companies.

"When the plaintiff Zhu Yuanlin and the defendant Ye Sijie asked them to provide guarantees, the two companies clearly stated that they must be approved by the higher-level competent authorities. The plaintiff Zhu Yuanlin and the defendant Ye Sijie immediately stated that they were responsible for coordinating the relationship with the higher-level authorities of the two defendants. The two defendants provided one copy of the "Letter on the Asset Management of Enterprises Under the Women's Labor Camp in Sichuan Province" [Chuan Laogai Han (2013) No. 7]."

  The two companies stated that it was the letter provided by the plaintiff and the defendant that “caused the second defendant’s misunderstanding and caused the second defendant to provide a guarantee against the true meaning.”

  The Paper noted that the content of the letter read: “In order to effectively integrate the fixed assets of Sichuan Women’s Labor Camp and its subsidiaries: Sichuan Xingnan Trading Co., Ltd. and Sichuan Xingnan Craft Products Factory, we will strengthen the efficient management of their assets. And use, the Sichuan Women’s Forced Labor Camp is authorized to take full control of the relevant real estate within the property rights of the above-mentioned two enterprises in accordance with relevant management measures and procedures."

  The court held that, as an internal official document of an administrative agency, its source can only be the administrative agency that issued the document or received the document, and it may not be a natural person other than the administrative agency to give to the relevant unit.

The court stated that “the source of the documents is not in conformity with the conventional channels, and it should be reasonably suspected and verified by the Sichuan Provincial Administration of Labor Reeducation and Rehabilitation.” However, the two companies apparently did not confirm the documents.

At the same time, the court held that the letter only involved asset management authorization and had nothing to do with the secondary guarantee.

  According to people familiar with the matter, Zhu Huaizhong was actually suspended last year to collect debts.

Insiders believe that these capital flows may be "related to the family business" of Zhao Zeyong.
