27 July 2020 Mina Welby and Marco Cappato were acquitted by the assize court of Massa, because the fact does not exist, from the charge of suicide aid for the death of Davide Trentini, the 53-year-old Sla patient who died on 13 July 2017 in a clinic Switzerland.

Cappato:" Moral duty, I would do it again "
" We have provided undeniable help in the absence of any legal requirement. We helped Trentini on the basis of a moral duty and I would do it in exactly the same way. At the court I would like to remind you that since the death of DJ Fabo and Trentini, dozens of other people have gone to Switzerland for assisted suicide and the Italian authorities have been informed by Swiss authorities. However, no criminal proceedings have opened. Those people didn't need us, because they had the money to do it and they also had those who carried them. But this cannot be the distinction between suffering patients ". It is the spontaneous declaration that Marco Cappato made to the judges before the assize court of Massa withdrew to the council chamber for the sentence.

The prosecution had asked 3 years and 4 months
During his indictment, the prosecutor at the trial explained: "I ask for the sentence, but with all the extenuating circumstances and at the legal minimums. The crime of suicide aid exists, but I believe in their noble intentions. An act was carried out in the interest of Davide Trentini, who lacks the conditions that make it lawful. Guilty, yes, but deserving of some extenuating circumstances which I do not want to deny in conscience ".
