Citizens will register this Friday in Congress a bill that can put the PSOE in trouble. A rule against squatters that hardens the crime of usurpation in the Penal Code and speeds up the expulsions of those who illegally assault a house and appropriate it. The law contradicts the Podemos discourse, which has sometimes defended those who squatter homes with a supposed social objective.

And the socialists will have to choose between debating and processing a norm that may be controversial for a certain left or reject the initiative of Cs, with whom they now have an excellent relationship.

As EL MUNDO, who has had access to the text, has learned, the proposal proposes to reform the Penal Code, the Criminal Procedure Law and the Law of Bases of the Local Regime, among other laws. As Cs parliamentary spokesman Edmundo Bal explains, it is about judges being able to expel squatters at a preview if they cannot demonstrate their right to use the home, a summary and preferred procedure. After the launch, the trial could take place if the squat insists on its right of use.

In this way, the eviction of a squatter, which may take up to two years now, depending on the judicial saturation of each city, could be expedited to last six months, according to the liberal spokesman.

It is a blatant crime

The State's lawyer considers that squatting is in itself a flagrant crime and could be prosecuted by the State Security Forces and Corps if there were a general order from the Attorney General's Office. "That would be the ideal," says Bal, "as has happened in the Balearic Islands, where the chief prosecutor has issued an instruction for the National Police and the Civil Guard to act against squats in the region, which have been reduced in recent months. ».

Ciudadanos already registered a similar proposition in 2018, but the legislature waned and did not give it time to debate it. This time, the Cs Parliamentary Group plans to present the consideration of this rule before the Plenary after the summer. This will happen while keeping all channels of dialogue open with the Government and the PSOE, including the negotiation of the next General State Budgets.

The Cs leadership recognizes that its strategy of approaching the Government to agree to extensions of the state of alarm or sanitary decrees of social distancing also involves distancing itself from Podemos and condemning its "populism" and its "demagoguery".

"The sewers of Podemos"

In fact, and in the face of the Dina case , which directly affects Pablo Iglesias, Inés Arrimadas's party has demanded that the vice president give explanations in parliamentary headquarters. Finally, "the sewers that they denounced may end up being the sewers of Podemos," explains Cs spokeswoman Melisa Rodríguez .

The norm to be debated in Congress establishes that the owners' boards can act against intruders. And it also gives special powers to the municipalities so that they can end an occupation when a community of neighbors asks them to act, if the owner does not initiate legal actions.

Liberal education has often positioned itself in favor of tightening the law against squatting and speeding up the eviction of intruders. The deputy mayor of Madrid, Begoña Villacís, has reiterated that the municipalities do not have sufficient legal tools to fight against a particularly serious scourge in some neighborhoods of the capital, in other large cities and in tourist areas.
