The Ministry of Ecology and Environment is studying and drafting the proposed draft revision of the Noise Pollution Prevention Law

  As the 2020 college entrance exam is approaching, many local ecological and environmental departments throughout the country have issued notices that prohibit all kinds of construction from disturbing the public at night, so that the majority of candidates can quietly prepare for the exam. Among them, some places such as Beijing have also disclosed the report to the public.

  In fact, in recent years, the problem of noise pollution has become increasingly prominent, and public noise pollution reports have even exceeded atmospheric pollution. The latest report issued by the Ministry of Ecology and Environment on the national “12369 Environmental Reporting Networking Management Platform” accepted in May this year showed that the largest volume of noise pollution reports in May was the most prominent problem.

  The Ministry of Ecology and Environment pointed out that in May, among the various pollution reports accepted by the "Network Management Platform", the most reported were noise pollution, accounting for 60.1% of the total reports, of which, the reports reflecting industrial noise pollution accounted for 57.3% of the noise reports, followed by To reflect the reports of construction noise pollution, it accounted for 32.1%. In May, the report of noise pollution surpassed the first report of air pollution.

  Why is the problem of noise pollution so prominent? my country's noise pollution prevention law has not been revised for many years, which may be the crux of the problem.

  According to Bie Tao, director of the Department of Regulations and Standards of the Ministry of Ecology and Environment, the Noise Pollution Prevention Law has been implemented for 24 years, during which it has never been revised, and there are no supporting administrative regulations and rules.   Bie Tao revealed that recently, the State Administration of Market Supervision reported the results of public service quality monitoring in 12 fields in 160 cities across the country in 2019, and the score of the evaluation indicators for "peripheral noise control" in the field of ecological environment is low. The environmental complaints reported by the ecological environment department accounted for more than 60% of the noise complaints reported in large and medium cities. Bie Tao believes that this reflects the necessity of timely revision of the Noise Pollution Prevention Law.

  He said that the Noise Pollution Prevention Law (Amendment) has been included in the legislative plan of the 13th NPC Standing Committee, and the revision of this law is led by the NPC Environmental and Resources Committee. In December 2018, the National People's Congress Environmental and Resources Commission sent a letter entrusting the Ministry of Ecology and Environment to draft a proposed draft revision of the Noise Pollution Prevention Law. Bie Tao said that the Ministry of Ecology and Environment is seriously studying and demonstrating and soliciting opinions from all parties, and is working on the drafting of the revised draft.

  How to modify the Noise Pollution Prevention Law? Bie Tao said that the revision of this law will combine with the new requirements of ecological environment management in the new era, adhere to the problem-oriented, highlight the key points, and actively and steadily advance. Among them, the source control will be emphasized, and the important role of the plan in the prevention and control of environmental noise pollution will be implemented to prevent and control the source; strengthen the supervision of various environmental noise sources such as industrial production, construction, transportation, and social life.

  At the same time, it will focus on key issues. The key point is to focus on solving outstanding problems such as unclear division of department management responsibilities, insufficient prevention and control at the source, and unclear penalties in the prevention and control of environmental noise pollution. Strengthen the research and demonstration of relevant systems to ensure that the system is feasible and effective.

  Bie Tao said that through the revision of this law, it will improve governance capabilities, strengthen government supervision and management responsibilities, clarify the supervision responsibilities of various departments, implement the main responsibility of noise emission units to prevent and control pollution, and strengthen social co-governance.

  Bie Tao said that the revision of the Noise Pollution Prevention Law will fully draw on the successful management experience in relevant laws and regulations and practices within and outside the country (territory), promote consensus and improve governance effectiveness.
