The Generalitat of Catalonia has decreed its second confinement of the Covid-19 pandemic. After having isolated 70,000 people in Igualada before the state of alarm, the Catalan Government once again seized its powers in the field of civil protection and the gaps in state health legislation to confine 210,000 inhabitants of the Segrià region, formed by the city ​​of Lérida and other 37 municipalities.

DOES THE GENERALITAT HAVE COMPETENCES TO CONFINE?

The confinement dictated by the Generalitat has legal coverage. The Catalan government claims to act "within the framework of health and public health and civil protection legislation" to isolate 210,000 of its inhabitants and there are laws that protect it.

In health matters, the Organic Law on Special Measures in Public Health Matters of 1981 establishes that "the competent health authorities" -in this case, the Ministry of Health of the Generalitat after the state of alarm has declined- "may adopt measures of recognition, treatment , hospitalization or control when rational indications are appreciated that allow the existence of a danger to the health of the population to be assumed due to the specific health situation of a person or group of people or due to the health conditions in which an activity is carried out ”. A copy that was made with treatment-resistant tuberculosis in mind, for example, and can now be applied to Covid-19.

In addition, as it did with the confinement of Igualada, the Catalan Government clings to the Civil Protection Law of Catalonia, which designates the President of the Generalitat and the Minister of the Interior as "the highest authority of civil protection in Catalonia, without prejudice of what the State legislation has in the assumptions of situations of serious collective risk, catastrophes or public calamities ».

The same legislation, in its article 9, establishes that said authority can “evacuate or remove people from dangerous places, recommend the confinement of people in their homes or safe places, limit and condition the use of public and private services and other emergency measures deemed necessary. " The civil protection law establishes that said measures "shall be in force for the time strictly necessary and must be proportional to the emergency situation." An open article, to which the Generalitat clings to dictate an indefinite confinement temporarily.

Likewise, the resolution issued this Saturday by the Generalitat refers to the decree signed by the President of the Generalitat on June 18, in which “it left without effect the state of alarm” and empowered the Minister of Interior and Health Minister “to that they adopt the necessary resolutions to give effect to the measures that should govern the new stage that is beginning "; the one baptized as "stage of resumption" in Catalonia. Miquel Buch and Alba Vergés are the ones who sign the resolution "by which it is agreed to restrict the departure of people from the Segrià region".

WHO CAN ENTER THE AREA?

From 4 pm on Saturday, you will not be able to enter or leave the Segrià region, except for work reasons. The confinement has been issued since 12 noon, but the Generalitat has granted four hours of margin so that people with domiciles in the area can return to their homes and for those who were visiting they can leave the perimeter space.

Starting Tuesday, a self-responsibility certificate and a workplace certificate will be necessary to enter and leave the isolated region.

WILL IT BE POSSIBLE BY TRAIN OR CAR?

It will be possible to circulate on the motorways or highways that cross the region -like the AP-2 and the A-2- "if the origin or destination is not within the isolated area. And you will only be allowed to arrive by train if it is for work reasons.

The residents of the confined municipalities may move between populations within the perimeter, but the Generalitat advises against doing so.

WHAT OTHER LIMITATIONS ARE IMPOSED?

In addition to restricting mobility, the Generalitat has prohibited meetings of more than 10 people, "either in the private or public sphere", with the aim of limiting infections.

The Govern also prohibits family visits to nursing homes, closes day centers for the elderly and recommends that older people remain confined to their homes and leave only for the "absolutely essential".

FOR HOW LONG IS IT CONFINED?

Contrary to what happened in Igualada -when an initial confinement of 15 days was issued, which ended up extending more than two months-, the Generalitat has ordered an indefinite confinement in Lérida and its adjacent populations. It will be in force "until a new resolution is issued, modifying or canceling it", reads the resolution of the Govern. The Minister of the Interior, Miquel Buch, has pointed out that the confinement will have "a minimum period of 15 days". "We have a start date, but the end date is not marked," he admitted.
